RESOLUTION NO. 5097 <br /> <br />BY:Messrs. Graber, Mmgnotto~ McBride, <br /> Sinagra, Usher, Brockman, Chinnock <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public Works <br />to enter into a contract with Webber Equipment Company to purchase one <br />Roto-Clone as manufactured by American Air Filter Company for the Waste- <br />water Treatment Plant. <br /> <br /> WHEREAS, the Roto-Clone is an integral part of the sludge drying <br />system originally installed by the American Air Filter Company at the Waste- <br />water Treatment Plant, and, <br /> <br /> WHEREAS, the Roto-Clone has worn to the point where it is beyond <br />repair, and,. <br /> <br /> WHEREAS The Webber Equipment Company 2820 Detroit, Cleveland, Ohio, <br />is the local representative for American Air Filter Company and can obtain <br />this piece of equipment, and, <br /> <br /> WH£REAS, pursuant to Ohio Revised Code 735.051 the legislative <br />.authority of a municipal corporation may, bya two-thirds vote, contract <br />for the purchase of equipment without formal bidding and advertising in the <br />case of a real emergency arising in connection with the operation and main- <br />tenance of the Department of Public Works, and, <br /> <br /> WHEREAS, a real and present emergency exists in the usual daily <br />operation of the Wastewater Treatment Plant of the City of Lakewood in that <br />this gas cleaning equipment is an integral part of the sludge drying process, <br />it is immediately necessary to enter into a contract for the aforesaid equip, <br />ment'for the immediate preservation of the public health, safety and welfare; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works is hereby authorized <br />and directed to enter into a contract with Webber Equipment Company to pur- <br />chase a Roto-Clone as manufactured by American Air Filter Company for an <br />amount not to exceed $7,500.00. <br /> <br /> Section 2. That there is hereby appropriated from the Federal Revenue <br />Sharing FUnd an amount not to exoeed $7,500 to be paid as the purchase price <br />for said Roto-Clone. <br /> <br /> Section 3. That this Resolution is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof and pro¥ided it <br />receives the affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor. <br /> <br />Mayoe~ <br /> <br /> <br />
