RESOLUTION NO. 5098 BY: Messrs. Brockman, Chinnock, Graber, Magnotto, McBride, Sinagra, Usher AN EMERGENCY RESOLUTION declaring the necessity and intent of the City of Lakewood to appropriate the fee simple interest in and to the real property located at 1448 Warren Road, Lakewood, Ohio, owned by the Lakewood Drive-In Company, an Ohio Corporation. WHEREAS, the real property hereinafter more fully described is needed for one or more of the municipal purposes set forth in Section 719.01 of the Ohio Revised Code, and WHEREAS, this Resolution constitutes an emergency measure providing for the usual daily operation of a municipal department and for the immediate preservation of the public health, safety and welfare and it is in the best interest of the City to proceed to acquire said property at the earliest possible time; now~ therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby determines it necessary and declares its intention to appropriate for one or more of the municipal purposes set forth in Section 719.01 of the Ohio Revised Code, the fee simple interest in and to the premises situated at 1448 Warren Road, Lakewood, Ohio and further described as follows: Situated in the City of Lakewood, County of Cuyahoga and State of Ohio, and known as being all of Sub Lot No. i and part of Sub Lot No. 2 in J. E. Tegardine Subdivision of part of Original Rockport Township Section No. 22, as shown by the recorded plat in Volume 29 of Maps, Page 19 of Cuyahoga County Records, and part of Original Rockport Township Section No, 22, bounded and described as follows: Beginning in the Westerly line of Warren Road at the Southeasterly corner of said SuB Lot No. 1; thence Northerly along the Westerly line of Warren Road, 76 feet to a point 30 feet Northerly measured along said Westerly line of Warren Road from the Northeasterly corner of said Sub Lot No. 1; thence Westerly parallel to and 30 feet Northerly from the Northerly line of Sub Lot No. 1, a distance of 168 feet; thence Westerly about 121 feet to a point in the Easterly line of Victoria Avenue, which point is 88 feet North on said Easterly line from the Northwesterly corner of property of Board of Education; thence Southerly on the Easterly line of Victoria Avenue, 88 feet to the Northwesterly corner of property of Board of Education; thence Easterly on said Northerly line and along the Southerly line of said Sub Lot No. 1, about 284~68 feet to the place of beginning, as appears by said plat, be the same more or less, but subject to all legal highways. Owner: The Lakewood Drive-In Company, an Ohio Corporation Permanent Parcel Numbers: 314-4-14 and 20 Section 2. That the Clerk of Council be and she is hereby authorized and directed to cause written notice of the adoption of this Resolution to be given to the owner, persons in possession of, or persons having an interest of record in the above described premises, or to his authorized agent, and said notice shall be served by a person designated for the purpose by said Clerk of Council, and return made in the manner provided by law for the service and return of summons in civil actions.
