RESOLUTION NO. 5098 <br /> <br />BY: Messrs. Brockman, Chinnock, Graber, <br /> Magnotto, McBride, Sinagra, Usher <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity and intent of the <br />City of Lakewood to appropriate the fee simple interest in and to the real <br />property located at 1448 Warren Road, Lakewood, Ohio, owned by the Lakewood <br />Drive-In Company, an Ohio Corporation. <br /> <br /> WHEREAS, the real property hereinafter more fully described is <br />needed for one or more of the municipal purposes set forth in Section 719.01 <br />of the Ohio Revised Code, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing <br />for the usual daily operation of a municipal department and for the immediate <br />preservation of the public health, safety and welfare and it is in the best <br />interest of the City to proceed to acquire said property at the earliest <br />possible time; now~ therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby determines it necessary and <br />declares its intention to appropriate for one or more of the municipal <br />purposes set forth in Section 719.01 of the Ohio Revised Code, the fee simple <br />interest in and to the premises situated at 1448 Warren Road, Lakewood, Ohio <br />and further described as follows: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State <br />of Ohio, and known as being all of Sub Lot No. i and part of <br />Sub Lot No. 2 in J. E. Tegardine Subdivision of part of Original <br />Rockport Township Section No. 22, as shown by the recorded plat <br />in Volume 29 of Maps, Page 19 of Cuyahoga County Records, and <br />part of Original Rockport Township Section No, 22, bounded and <br />described as follows: <br /> <br />Beginning in the Westerly line of Warren Road at the Southeasterly <br />corner of said SuB Lot No. 1; thence Northerly along the Westerly <br />line of Warren Road, 76 feet to a point 30 feet Northerly measured <br />along said Westerly line of Warren Road from the Northeasterly <br />corner of said Sub Lot No. 1; thence Westerly parallel to and <br />30 feet Northerly from the Northerly line of Sub Lot No. 1, a <br />distance of 168 feet; thence Westerly about 121 feet to a point <br />in the Easterly line of Victoria Avenue, which point is 88 feet <br />North on said Easterly line from the Northwesterly corner of <br />property of Board of Education; thence Southerly on the Easterly <br />line of Victoria Avenue, 88 feet to the Northwesterly corner of <br />property of Board of Education; thence Easterly on said Northerly <br />line and along the Southerly line of said Sub Lot No. 1, about <br />284~68 feet to the place of beginning, as appears by said plat, <br />be the same more or less, but subject to all legal highways. <br /> <br />Owner: The Lakewood Drive-In Company, an Ohio Corporation <br /> <br />Permanent Parcel Numbers: 314-4-14 and 20 <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized <br />and directed to cause written notice of the adoption of this Resolution to be <br />given to the owner, persons in possession of, or persons having an interest of <br />record in the above described premises, or to his authorized agent, and said <br />notice shall be served by a person designated for the purpose by said Clerk of <br />Council, and return made in the manner provided by law for the service and <br />return of summons in civil actions. <br /> <br /> <br />
