RESOLUTION NO. 5108 BY: Messrs. Brockman, Chinnock, Gcaber, Magnotto, McBride, Sinagra, Usher AN EMERGENCY RESOLUTION authorizing and directing the Finance DireCtor of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 314-22-125, and known for street numbering purposes as 2075 Ferndale Avenue, Lakewood, Ohio, on the Cuyahoga County Auditor's records and authorizing the Connty Auditor to cancel sai~ special assessment for the year 1976. WHEREAS, the City of Lakewood has special assessment charged against the prop- erny hereinafter described and levied ul~der Ordinance No. 27~72, adopted by the Council of the City of Lskewood on March 6, 1972, and WHEREAS, the owner of the said property bas tendered payment of the principal portion and interest on the special assessment levied on said parcel pursuant no the provisions of Section 5716.16 of the Revised Code of the State of Ohio, and WHEREAS, this resolution constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore: BE IT RESOLVED BY THE COUNCIL OF THE CI~[~ OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed no accept the sum of $26.04 tendered in payment of~the przncipal and interest f~r the year 1976, of special assessment charged against the property described as permanent parcel number 314-22-125 on the Auditor's records of Cuyahoga County, Ohlo, and levied ~lnder Ordinance No. 27-72, adopted by the Council of the City of Lakewo~d on March 6, 1972. Section 2. ~at said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuy~hoga County be and he is hereby authorized to cancel said special assessn~ent ~or the year 1976, levied under Ordinance No. 27-72, adopted by the Council of the City of Lakewood on M~rch 6, 1972, on permanent parcel number 314-22-125 on the County Auditor's Records and further described as being in the Ferndale Avenue Dedication, Volume 106, Page 25, each annual assessment being in the amount of $26.04 Section 3. That the Clerk of Council be and she is hereby authorized and directed to deliver a certified copy of this resolution to the A~ditor of Cuyahogs County for the purpose of having said special assessmen~ canceled. Section 4. ~hat this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and prf~d~ded it receives the affirmative vote of two-thirds of all members ele.~d t~ Counci~al~.take effect and be in force immediately upon its adop~£on ~n~ app~o~a~ ,~//tne m~yor.
