RESOLUTION NO. <br /> <br />5112 <br /> <br />BY: Messrs. Sinagra, Usher Brockman, <br /> Graber, Magnotto <br /> <br /> AN EMERGENCY RESOLUTION providing assurance to the United States <br />Envirlonmental Protection Agency that the City has the legal, institutional, <br />managerial and financial capability to insure construction, proper operation <br />and maintenance of its sewage treatment works and agreeing to pay all non- <br />federal project cests. <br /> WBEREAS, the United States Environmental Rrotection AgenCy has <br />amended Part 35 of Title 40, Code of Regulations, to include regulations <br />for industrial cost recovery pursuant to Section 204 (b) of the Federal <br />Water Pollution Control Act Amendments of 1972, and <br /> WHEREAS, said regulations require that an industrial cost recovery <br /> system be adopted, by all recipients of sewage treatment works grants, and <br /> WHEREAS, the.City of Lakewood is desirous of obtaining a federal <br /> granlt in an estimated amount equal to 75% of the necessary funds required to <br /> compilete a Step 1 facilities plan study, and <br /> WHEREAS, this Resolution constitutes an emergency measure providing <br /> for the usual daily operation of a municipal department and for the further <br /> reason that the application for a Step 1 facilities plan study should be made <br /> at the earliest possible time; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section t. That the City of Lakewood, Ohio hereby provides assurance <br /> to the United States Environmental protectiOn Agency that it has the legal, <br /> institutiona~ managerial and financial capability tO insure construction, <br /> proper operation and maintenance of treatment works t~roughout its jurisdict%on. <br /> Section 2. That the City of Lakewood hereby agrees to pay all non- <br /> federal project costs in connection with any sewage treatment works grants <br /> rec!eived. <br /> Section 3.
