RESOLUTION NO. <br /> <br />BY: Messrs. Usher, Brockman, Chinnock, <br /> McBride, Salmon, Sinagra, <br /> <br /> AN EMERGENCY ~RESOLUTION authorizing the Director of Public Works <br />to enter into a contract with Avery Engineering, to fabricate and install <br />chill water coils in the City Hall air conditioning.equipment in an amount <br />not to exceed $12,862.00. <br /> <br /> WHEREAS, a recent investigation has revealed the air conditioning <br />equipment is in generalqy good condition with the exception of the copper <br />chill water coils which ar~ badly corroded, partially plugged, and leaking <br />in many locations, and, <br /> <br /> WHEREAS, following the usual procedure of advertising for bids <br />for this work would reguire approximately six months because the coils <br />would have to be fabricated after receipt of the bid, add would cost ap- <br />proximately $22,000.00, and, <br /> <br /> WHEREAS, Avery Enqineering have the shop facilities to fabricate <br />and install these chill' water coils and will give us an estimated credit <br />of between $1500.00 and $2000.00 for the coils to be replaced, and, <br /> <br /> WHEREAS, pursuant to Ohio Revised Code 735.051, the legislative <br />authority of a munlcip~'l corporation may, by a two-thirds vote, contract <br />for the purchase of e~ipment without formal bidding and advertising in the <br />case of a real emergenc~' arising in connection with the operation and main- <br />tenance of the Department of Public Works, and, <br /> <br /> WHEREAS, a r~al and present emergency exists in the usual daily <br />operation of the City Hall in that the chill water coils in the air con- <br />ditioning system need to be replaced at the earliest opportunity and it <br />is necessary to enter i'nto a contract immediately in order to insure the <br />equipment being ooerabl~e for the summer months to provide for the pre- <br />servation of the public health, safety and welfare; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That the Director of Public Works is hereby authorized <br />and directed to enter:{nto a contract with Avery Engineering to provide all <br />necessary fabricatiOni2ind labor to install new chill water coils in the City <br />Hall air conditioningi6'qUipment in an amount not to exceed $12,862.00. <br /> , <br /> Section 2, ~hat this Resolution is hereby declared to be an <br />emergency measure for!the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, ~t shall takeleffeCt and be ~n force ~mmed~ately upon its adoption <br />and approval ..by the M~.~'Or <br /> <br />Clerk <br /> <br />Mayor <br /> <br /> <br />
