RESOLUTION NO. 5220 <br /> <br />BY: Messrs. Sinagra, Usher, Brockman, <br /> Chinnock, Magnotto, McBride, Salmon <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Mayor, as Director of Public <br />Safety, to enter into a contract with Western World Insurance Company, Inc. to <br />purchase a Law Enforcement Officers' Professional Liability Policy covering the <br />law enforcement officers of the City of Lakewood. <br /> <br /> WHEREAS, the professional liability insurance policy maintained by the <br />City covering its law enforcement officers expired at midnight March 31, 1977, <br />and <br /> <br /> WHEREAS, the only bid received for such insurance by the City was <br />rejected by the Board of Control on March 31, 1977, and <br /> <br /> WHEREAS, a real and present emergency exists in the usual daily opera- <br />tion of the Department of Public Safety of the City of Lakewood in that it is <br />essential that the City's law enforcement officers be protected by a professional <br />liability insurance policy, it is, therefore, immediately necessary to enter into a <br />contract to purchase such a professional liability policy, and <br /> <br /> WHEREAS, pursuant to the law of Ohio and Ohio Revised Code 735.051 the <br />legislative authority of a municipality may, by a two-thirds (2/3) vote of all the <br />members elected thereto, authorize the Director of Public Safety to enter into such <br />a contract without formal bidding and advertising in the case of a real and present <br />emergency arising in connection with the operation of the Department of Public Safety; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor is hereby authorized and directed to enter into <br />a contract with Western World Insurance Company, Inc. to purchase a Law Enforcement <br />Officers' Professional Liability Insurance Policy for a period of one year for an <br />amount not to exceed Fifteen Thousand One Hundred Fourteen Dollars ($15,114.00). <br /> <br /> Section 2. It is hereby appropriated from the General Fund an amount <br />not to exceed Fifteen Thousand One Hundred Fourteen Dollars ($15,114.00) to be <br />paid for the purchase price of said insurance policy. <br /> <br /> Section 3.
