RESOLUTION NO. 5231 BY: <br /> <br />Messrs. Brockman, Chinnock, McBride, <br />Salmon, Sinagra, Usher <br /> <br /> AN EMERGENCY RESOLUTION objecting to the renewal of D-5 and D-6 liquor <br />permits issued to Telstar, Inc. for an establishment located at 18500 Detroit <br />Avenue in the City of Lakewood, Ohio, and requesting a hearing. <br /> <br /> WHEREAS, D-5 and D-6 liquor permits have been issued by the Ohio <br />Department of Liquor Control to Telstar, Inc. for an establishment located at <br />18500 Detroit Avenue, Lakewood, Ohio, and <br /> <br /> WHEREAS, said liquor permits will be up for renewal in the latter part <br />of 1977, and <br /> <br /> WHEREAS, the applicant for said permits has operated said liquor permit <br />businesses in a manner that demonstrates a disregard for the laws, regulations <br />and local ordinances of the State of Ohio and the City of Lakewood, and <br /> <br />building, <br />the place <br /> <br />WHEREAS, the place for which the permit is sought does not conform to the <br />safety or health requirements of the governing body of the City of Lakewood, <br />in which said establishment is located, and <br /> <br /> WHEREAS, this Council determines that the renewal of said permits fs <br />contrary to the best interest of the entire community and would place additional <br />burdens upon the facilities of the Lakewood Police Department, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure in that it ~ <br />provides for the immediate perservation of the public health, safety and welfare; <br />.no¥, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, SLATE OF OHIO: <br /> <br /> Section 1. That this Council hereby strenuously objects to the renewal <br /> by the Department of Liquor Control of the State of Ohio of the D-5 and D-6 liquor <br /> permits issued to Teista~, Inc. for premises known as 185Q0 Detroit Avenue, Lakewood, <br /> Ohio for the reasons above set forth, all in accordance with the provisions of <br /> Section 4303.271 and Section 4303.292 of the Revised Code of Ohio. ~ <br /> <br /> Section 2. That this Council, as the legislative authority of the City <br />of Lakewood~ hereby requests a hearing on the foregoing objections as provided in <br />Section 4303.271 of the Revised Code of Ohio. <br /> <br /> Section 3. That the Clerk of Council is hereby authorized and directed to <br />transmit two certffied copies of this Resolution, together with two copies of a <br />statement of the Law Director of the City of Lskewood that in his opinion the objec- <br />tion is based upon substantial legal grounds and w~thtn the messing and ~ntent of <br />division (A) of Section 4303.292 of the Revised Code, and two copies of a letter <br />requesting that the hearing be held in Cleveland, Cuyahoga County, to the Department <br />of Liquor Control, State o~ Ohio, Permit Division, no later than August 15, 1977. <br /> <br /> Section 4. That this Council designates the Law Department of the City <br />of Lakewood to represent it and the City of Lakewood at any bearings before the <br />Department of Liquor Control <br /> <br />Adopted: <br /> <br /> Section 5. That this Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided 5t receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force from and after the earliest period <br />allowed ~y law. <br /> <br /> / / Pr~ident <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
