RESOLUTION NO. 5240 <br /> <br />BY: Messrs. McBride, Salmon, Sinagra, <br /> Brockman, Chinnoek, Magnotto <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Law of the City of <br />Lakewood to institute an action in the Common Pleas Court of Cuyahoga County, Ohio <br />to declare the premises at 15538 Madison Avenue, Lakewood, Ohio to be a public <br />nuisance, to enjoin the same and to seek such other and further relief as the <br />Court may deem proper. <br /> <br /> WHEREAS, the Departments of Fire and Building of the City of Lakewood <br />have determined after a thorough inspection that the premises located at 15538 <br />Madison Avenue, Lakewood, Ohio are a violation of the Building Code of the City <br />and are a fire and safety hazard, not only to any person who may occupy said <br />premises but also to the surrounding neighborhood, and that said premises are a <br />public nuisance, and <br /> <br /> WHEREAS, previous attempts by officials of the City to abate such <br />nuisance and to require the occupant of said premises to comply with the Codes of <br />the ~City have been to no avail, and <br /> <br /> WHEREAS, this Council deems it of utmost importance to the City of <br />Lakewood that said premises be brought into compliance with all City codes, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for <br />the ~immediate preservation of the public safety, health and welfare in that immed- <br />iatel steps should be taken to abate an existing public nuisance and provides for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY ~HE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Law of the City of Lakewood be and he is <br />hereby authorized to prepare and file a Complaint in the Common Pleas Court of <br />Cuyahoga County, Ohio declaring the premises at 15538 Madison Avenue, Lakewood, Ohio <br />to be a public nuisance, to seek a temporary and permanent injunction against the <br />owner and/or occupant of said premises from maintaining a public nuisance and from <br />failing and/or refusing to comply with the directives of the City of Lakewood and <br />for such other and further orders and relief as the Court may deem appropriate, <br />just and equitable with respect to said premises. <br /> <br /> Section 2. That this Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor, <br />otherwise it shall take effect and be in force from and after the earliest period <br />allowed by law. <br /> <br /> / <br /> <br />Mayor <br /> <br /> <br />
