RESOLUTION NO. 5266 BY: Messrs. Brown, Chinnock, Magnotto, McBride, Salmon, Usher, Brockman AN EMERGENCY RESOLUTION requesting the Auditor of CuyahogB County to draw and the Treasurer Of Cuyahoga County to pay to the Director of Finance of the City of Lakewood an advance of takes collected for the year 1978 in such amounts as may be requested and availabte~ WHERE~S, Section 321.34 of the Revised Code provides that when local authorities by resolutian so request, the County Auditor shall draw and the County Treasurer shall pay on such draft to township cterks, treas- urers of municipal corporations, the Clerk of any Board of education, and the treasurer of any Other political subdivision or taxing district whose funds derived from taxes or other sources are payable by law to th~ County Treasurer, any money thak may be in the county treasury to the acnou, nts of such local authorities; and WHEREAS, it will be necessary for the City of Lakewood to obtain an advance of taxes prior to the regular tax settlement for the year; and WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public property and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVBD BY THE COUNCIL OF TNE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Auditor of Cuyahoga County be requested to draw and the Treasurer of Cuyaboga County be reqpested to pay to the Director of Finance of the City of Lakewood, State of Ohio, an advance of taxes for the year 1978 in such amount as may b~ requested of him and which are available. Section 2. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereOf and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval bythe Mayor.
