RESOLUTION NO. 5302 <br /> <br />BY: Messrs. Brockman, Brown, <br /> ChLnnock, Magnotto, McBride, <br /> Salmon, Usher <br /> <br /> AN EMERGENCY RESOLUTION giving consent to the County of Cuyahoga <br />to make emergency repairs and resurfacing of the Hilliard Road Bridge No. 65 <br />over the Rocky River. <br /> <br /> WHEREAS, the County of Cuyahoga and the City of Lakewood have <br />considered the improvement of the public highway, which is described as <br />follows: <br /> <br />Rehabilitation of the HilliardRoadBridge No. 65 over the <br />Rocky River, and <br /> <br /> WHEREAS, the existing bridge is in need of emergency repairs and <br />resurfacing and iranediate action must be taken to maintain the traffic, and <br /> <br /> WHEREAS, emergency repairs and resurfacing is being considered as <br />al appropriate course of action and the initial phase of a larger project as <br />described above, and <br /> <br /> WHERFAS, this resolution is declared to be an emergency measure <br />necessary for the preservation of the public peace, health and safety, such <br />emergency existzng by reason of the present condition of sazd road and by <br />reason of the inadequacy of such road to handle exzsting and anticzpated <br />vehicular traffic between the points hereinbefore designated; in consequence <br />whereof great public inconvenience is being suffered and will be suffered and <br />public vehicular traffic endangered and delayed; mid for the further reason <br />that it is necessary to proceed at once in order to c~nplete the improvement <br />of said road during the coning year; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKE~0OD, STATE OF <br /> <br />Section 1. CONSENT <br /> <br /> That it is delared to be in the public interest that the consent of <br />said Municipality be and such consent is hereby given to the County of Cuyahoga <br />to construct the above-described improvement in accordance with plans, <br />specifications, and estimates as approved by the County. <br /> <br />Section 2. COOPERATION <br /> <br /> That said Municipality hereby proposes to cooperate with the County <br />in the cost of the above-described improvement as follows: <br /> <br />(a) <br /> <br />By the approval of an amendment to the existing application <br />for the larger project as described above for municipal <br />cooperation with the County in the cost of the improvement <br />project to the exigent of funds received by an allecation <br />from the County Motor Vehicle $5.00 License Tax Fund. <br /> <br />(b) <br /> <br />There shall be no roadway participation by said Municipality <br />for the aforesaid improvement over than the $5.00 License <br />T~x Funds. <br /> <br /> Section 3. That this resolution is hereby declared to be an emergency <br />n~asure for the reasons stated ~n the preamble hereof and provided it receives <br />the affirn~tive vote of two-thirds of all members elected to Council it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise at the earliest period allowed by law. ~ <br /> <br />/ ~ / Ma~6r <br /> <br /> <br />
