Brown, Chinnock, Magnotto, McBride, Salmon, Usher, Brockman AN t~V~GENCY RESOLUTION objecting to the transfer and issuance of D2 and D3 liquor permits to applicant MC COM, Inc. dba MACS for an establishment located at 18514 Detroit Avenue in the City of Lakewood. WHEREAS, MC COM, Inc. dba MACS has applied to the Department of Liquor Control of the State of Ohio for the transfer and issuance of D2 and D3 liquor permits for the premises known as 18514 Detroit Avenue, Lakewood, Ohio, and WHEREAS, investigation discloses that a member, officer, director or manager of the applicant has been convicted of a crime which relates to his fitness to operate a liquor establishment; and WHEREAS, this Council believes that neither the shareholders nor the officers or directors ofthe applicant corporation are the real parties in interest with respect to the transfer and issuance ofsaid D2 and D3 permits, and WHEREAS, this Council determines that the granting of these permits is contrary to the best interests of the entire corammity, and WHEP~EAS, this resolution constitutes an emergency measure in that it provides for the in~ediate preservation of the public health, safety and welfare; now, therefore, OHIO: BE IT RESOLVED BY THE O3UNCIL OF THE CITY OF LAKEWOOD, STATE OF Section 1. That this Council hereby strenously objects to the granting by the Department of Liquor Control of the State of Ohio of the application of MC COM, Inc. dba MACS, for the transfer and issuance of D2 and D3 liquor permits for the premises known as 18514 Detroit Avenue, Lakewood, Ohio, all in accordance with the provisions of Section 4303.26 of the Revised Code of Ohio. Section 2. That the Clerk of Council be and she is hereby authorized and directed to transmit two certified copies of this resolution, together with two copies of a letter of objection and two copies of a letter requesting that the hearing be held in Cleveland, Cuyahoga County, to the Department of Liquor Control, State of Ohio, Permit Division, no later than May 4, 1978. Section 3. ~lat this Council designates the Law Department of the City of Lakewood to represent it and the City of Lakewood at any hearings before the Department of Liquor Control. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affin~ative vote of two-thirds of all members elected to Council, it shall take effect and be in force imnediately upon its adoption and approval by the Mayor~ Approved:
