RESOLUTION NO~ 5307 BY: Messrs. Brown, Chinnock, <br /> Magnotto, McBride, Salmon, <br /> Usher, Brockman <br />AN t~V~GENCY RESOLUTION objecting to the transfer and issuance <br />of D2 and D3 liquor permits to applicant MC COM, Inc. dba MACS for an <br />establishment located at 18514 Detroit Avenue in the City of Lakewood. <br /> <br /> WHEREAS, MC COM, Inc. dba MACS has applied to the Department <br />of Liquor Control of the State of Ohio for the transfer and issuance of <br />D2 and D3 liquor permits for the premises known as 18514 Detroit Avenue, <br />Lakewood, Ohio, and <br /> <br /> WHEREAS, investigation discloses that a member, officer, director <br />or manager of the applicant has been convicted of a crime which relates to <br />his fitness to operate a liquor establishment; and <br /> <br /> WHEREAS, this Council believes that neither the shareholders <br />nor the officers or directors ofthe applicant corporation are the real <br />parties in interest with respect to the transfer and issuance ofsaid D2 <br />and D3 permits, and <br /> <br /> WHEREAS, this Council determines that the granting of these <br />permits is contrary to the best interests of the entire corammity, and <br /> <br /> WHEP~EAS, this resolution constitutes an emergency measure in that <br />it provides for the in~ediate preservation of the public health, safety <br />and welfare; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT RESOLVED BY THE O3UNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That this Council hereby strenously objects to the <br />granting by the Department of Liquor Control of the State of Ohio of the <br />application of MC COM, Inc. dba MACS, for the transfer and issuance of D2 <br />and D3 liquor permits for the premises known as 18514 Detroit Avenue, Lakewood, <br />Ohio, all in accordance with the provisions of Section 4303.26 of the <br />Revised Code of Ohio. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized <br />and directed to transmit two certified copies of this resolution, together <br />with two copies of a letter of objection and two copies of a letter requesting <br />that the hearing be held in Cleveland, Cuyahoga County, to the Department of <br />Liquor Control, State of Ohio, Permit Division, no later than May 4, 1978. <br /> <br /> Section 3. ~lat this Council designates the Law Department of the <br />City of Lakewood to represent it and the City of Lakewood at any hearings <br />before the Department of Liquor Control. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affin~ative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force imnediately upon its adoption <br />and approval by the Mayor~ <br /> <br />Approved: <br /> <br /> <br />
