RESOLUTION NO: <br /> <br />5319 BY: <br /> <br />Magnotto, McBride, Brockman, <br />Brown, Wendling <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity for renewing the <br />existing tax levy for current expenses of the City in excess of the ten mill <br />limitation, which existing tax levy is at the rate of 1.! mills on each dollar <br />of tax valuation on the taxable propert~ in the City of Lakewood for the reason <br />that the amount of taxes which may be raised within the ten mill /imitation by <br />levies on the current tax duplicate will be insnfficient to continue to provide <br />and adequate amount for the necessary requirements of the City, and that it is <br />therefore necessary to renew said tax levy in excess of the ten mill limitation <br />for the purpose of continuing to provide sufficient funds for the current expenses <br />of the City. <br /> <br /> ~EREAS, it is necessary to submit to the electors, at a general <br />election to be held on the 7th day of November, 1978, the question of a renewal <br />of ~ lavy for current expenses of the City, in excess of the ten mill limitation, <br />and an emergency has arisen to provide for the immediate preservation of the <br />public health, safety and property, and to provide for the usual daily operation <br />of municipal departments; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. This council hereby declares that the amoont of taxes which <br />may be raised by levies on the cwrrent tmx duplicate within the City, within the <br />ten mill limitation, the maximum rate authorized by Article XII, Section 2 of the <br />Ohio Constitution and Section 5705.02 of the Ohio Revised Code, will be insuf- <br />ficient to continue to provide an adequate amount for the necessary requirements <br />of the City of Lakewood, and for the purpose of continuing to provide sufficient <br />funds for current expenses, that it is necessary to levy a tax on the current <br />tax dup|icate in said City, for a period~of five yea~s, at a rate in excess of <br />such maximum rate authorized by the Ohio Constitution and the Ohio Revised Code <br />section herein cited. <br /> <br /> Section 2. That it is necessary to levy a tax on the current tax <br />duplicate for the years 1979, 1980, 1981, 1982 and 1983 at the rate for each year <br />of 1.1 mills on each dollar of tax valuation on the taxable property in the City <br />of Lakewood in excess of such rate authorized by the Ohio Constitution, Article <br />XII, Section 2 and Section 5705.02 of the Ohio Revised Code. The question of <br />such tax levy shall be submitted to the electors at a general election to be <br />held in the City, at the designated voting places, on November 7, 1978. <br /> <br /> Section 3. Tha~ the Clerk be and she is hereby directed to certify <br />a copy of this resolution to the Board of Elections of Cuyahoga County, Ohio in <br />order that said Board of Elections may make the necessary arrangements for the <br />submission of such question to the electors of said City as provided by law, <br />and upon ballots substantially in the following form: <br /> <br />PROPOSED TAX LEVY - (RENEWAL) <br /> <br /> A Renewai of a ta~ for the benefit of the City of LaRewood for <br />the purpose of providing sufficient funds for current expenses at a rate <br />not exceeding one a,d one tenth (1.1) miI]s for each one dollar, of <br />valuation which amouHts to eleven cents (!t~) for euch one huudred dollars <br />valuation, for the five (5) year period consisting of the tax years 1979 <br />to 1983, both inclusive. <br /> <br /> ) For the tax levy <br /> <br />Section 4. <br /> <br /> ( ) Agafnst the tax levy <br /> <br />Notice Of such election shall be published as req,i, red by <br /> <br /> <br />
