RESOLUTION NO: 5319 BY: Magnotto, McBride, Brockman, Brown, Wendling AN EMERGENCY RESOLUTION declaring the necessity for renewing the existing tax levy for current expenses of the City in excess of the ten mill limitation, which existing tax levy is at the rate of 1.! mills on each dollar of tax valuation on the taxable propert~ in the City of Lakewood for the reason that the amount of taxes which may be raised within the ten mill /imitation by levies on the current tax duplicate will be insnfficient to continue to provide and adequate amount for the necessary requirements of the City, and that it is therefore necessary to renew said tax levy in excess of the ten mill limitation for the purpose of continuing to provide sufficient funds for the current expenses of the City. ~EREAS, it is necessary to submit to the electors, at a general election to be held on the 7th day of November, 1978, the question of a renewal of ~ lavy for current expenses of the City, in excess of the ten mill limitation, and an emergency has arisen to provide for the immediate preservation of the public health, safety and property, and to provide for the usual daily operation of municipal departments; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. This council hereby declares that the amoont of taxes which may be raised by levies on the cwrrent tmx duplicate within the City, within the ten mill limitation, the maximum rate authorized by Article XII, Section 2 of the Ohio Constitution and Section 5705.02 of the Ohio Revised Code, will be insuf- ficient to continue to provide an adequate amount for the necessary requirements of the City of Lakewood, and for the purpose of continuing to provide sufficient funds for current expenses, that it is necessary to levy a tax on the current tax dup|icate in said City, for a period~of five yea~s, at a rate in excess of such maximum rate authorized by the Ohio Constitution and the Ohio Revised Code section herein cited. Section 2. That it is necessary to levy a tax on the current tax duplicate for the years 1979, 1980, 1981, 1982 and 1983 at the rate for each year of 1.1 mills on each dollar of tax valuation on the taxable property in the City of Lakewood in excess of such rate authorized by the Ohio Constitution, Article XII, Section 2 and Section 5705.02 of the Ohio Revised Code. The question of such tax levy shall be submitted to the electors at a general election to be held in the City, at the designated voting places, on November 7, 1978. Section 3.
