RESOLUTION NO, 5344 Messrs. Brockman, Chinnock, Magnotto, McBride, S~lmon AN ~IRGENCY ~LUTION authorizing and directing the Mayor, as ex-officio Director of Public Works, to enter into a contract with Richard Smith & Company to purchase two Meyco Pool Covers to be installed at the Madison Pool. WHEREAS, from past experience it has been determined that it is in the best interests to keep Madison Pool filled with water during the off season to prevent further deterioration, and WHEREAs, in order to properly preserve and protect the pOOl, it is i~nediately necessary to enter into a contract for pool covers, and WHEREAS; it is imperative that the pool covers be obtained iranediately so asto protect the City from liability, which may occur for reason of the fact that water is being maintained at the pool and, further, that the cover must be installed before inclement weather sets in, and WHEREAS, pursuant to Ohio Revised Code Section 735.051 the legislative authority of a m~micipal corporation may by two-thirds vote, contract for the purchase of equipment without formal bidding and advertising in ~the case of a real emergency arising in connection with the opera%ion and maintenance of the Department of Public Works, and WHEREAS, an ~nergency exists in the usual daily operation of the Public Works Department and it %s i~mediately necessary to enter into a contract for the aforesaid equipment for the i~mediatepreservation of the public health, safety and welfare;now, therefore, OF OHIO: BE IT. RESOLV~) BY THE COUNCIL OF THE CITY OF ~, STATE Section 1. That the Mayor, as ex-officio Director of Public Works, is hereby authorized and directed to enter into a contract with Richard ~ith & C~npany, P. O. t~ox 258, Columbia Station, Ohio 44028, to purchase two Meyco Pool Covers for the swiraning pool at MadisoJ Park for an amount not to exceed Six Thousand Dollars ($6,000.00). Section 2. Funds shall be provided from the Federal Revenue Sharing Fund in an amoont not Go exceed SLx Thousand Dollars ($6,000.00). Section 3. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all m~nbers elected to Council, it shall take effect and be in force ~n~nediately upon itsadoption and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period alloWed by law. ~ ~Z dopted: " . .
