<br /> AN EMERGENCY RESOLUTION objecting to the grantilng of D-1 liquor
<br />permit to applicant, Madison Square Lanes, Inc.,,for an elstablishment located
<br />at:1653 Westwood Avenue,: Lakewood, Ohio.
<br />
<br /> WHEREAS, Madi~ion Square Lanes, Inc. has appliedl to the Department
<br />of!Liquor Control, S~atel of Ohio, for the issuance for new D-1 liquor permit
<br />for the premises know~ ais 1653 Westwood Avenue, Uakewood,, Ohio, and
<br />
<br /> WHEREAS, an: i~nlvestigation discloses that the place for which the
<br />penmit is sought is s!o l~cated with respect to thel neighbbrhood that substantial
<br />interference with pubilic~ decency, sobriety, peace ,and/or pood order would
<br />result from the issuance of the permit and opera~i~on thereunder by the
<br />applicant, and
<br />
<br /> WHEREAS, th~ p~ace for which the permit! is sought is so situated
<br />wi~h respect to any school, church, library, and ipublic p~ayground that the
<br />operation of the liquor establishment will substain~ially and adversely affect
<br />or interfere with normali, orderly conduct of the ~a~fairs Of those facilities
<br />or institutions, and
<br />
<br /> WHEREAS, that ~he number of those permits already existent in the
<br />loclality is such that!tho granting of one new permit woul~ be detrimental
<br />to !and substantially interfere with the morals, s.afety or'welfare of the
<br />pubilic, and
<br />
<br /> WHEREAS, th~s Council determines that the granting of this permit
<br />is contrary to the best interest of the entire community,,and would place
<br />additional burdens upon the facilities of the Lak~ood Police Department, and
<br />
<br /> WHEREAS, this ~esolution constitutes
<br />provides for the immediate preservation of the
<br />welfare; now, therefore,,
<br />
<br />an~emergency measure in that it
<br />public health, safety and
<br />
<br />OHIO:

<br />BE IT RESOLVED~BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF
<br />
<br /> Section I. That this Council hereby strenuousl~ objects to the
<br />granting, by the Department of Liquor Control of the State of Ohio, of the
<br />application of Madison Square Lanes, Inc. for the,issuanc~ of new D-1 liquor
<br />permit for the premises known as 1653 Westwood Avenue, LaNewood, Ohio all in
<br />accordance with the provisions of Section 4303:261of the Revised Code of Ohio.
<br />
<br /> Section 2: That the Clerk of Council i~ hereby authorized.and directed
<br />to transmit two certified copies of this Resolution, together with two copies
<br />of a letter of objection~and two copies of a letter requesting that the hearing
<br />be ~eld in Cleveland, Cu~ahoga County, to the Department of Liquor Control,
<br />State of Ohio, Permit:Division, no later than March 8, 19~9.

<br /> Section 3. That this Council designates the LaN Department of the
<br />City of Lakewood to represent it and the City of Eakewood at any hearings before
<br />the~Department of Liquor'Control.
<br />
<br /> Section 4. That this Resolution is hereby declalred to be an emergency
<br />measure for the reasons s!tated in the preamble heneof and IProvided it receives
<br />the!affirmative vote of ~wo~thirds of all members elected 'to Council, it shall
<br />MayOr.take effect and be in forlce immediately upon its ~doption~? land approval~by
