RESOLUTION NO. 5388 BY;

<br /> A EMERGENCY RESOLUTION determining to amend Resolution No. 5362
<br />in order to revise the property o~'ners' share of the cost of improving
<br />Belle Avenue - Detroit to Franklin and Waterbury Avenue - Madison to Bramley.
<br />
<br /> WHEREAS, this Council has heretofore on January 15, 1979 adopted
<br />Resolution Not 5362 declaring it necessary to improve pomtions of Belle Avenue,
<br />Northland Avenue, Waterbury Avenue, Parkway Avenue, Lewis Drive, Wyandotte
<br />Avenue, Thoreau Avenue, Woodward Avenue, Parkhaven Row, Clarence Avenue and
<br />Wagar Avenue by grading, where necessary, of the base and by resurfacing
<br />with asphaltic concrete including the necessary replacement and resetting
<br />of castings together with necessary appurtenances thereto.

<br /> WHEREAS, in the aforesaid Resolution No. 5362,~this Council
<br />determined that those lots with frontage so benefited by,said improvements
<br />shall be assessed at the rate of $5.50 per foot of frontage, and
<br />
<br /> WHEREAS, the Board of Revision of Assessments at its hearing on
<br />March 22, 1979 recommended that becuase of the severe damage to Belle Avenue -
<br />Detroit to Franklin and Waterbury Avenue - Madison to Bramley, caused by
<br />the close proximity of the City parking garage, the substantial truck and
<br />bus traffice, as well as constant use by City of Lakewood Refuse vehicles,
<br />the property owners' portion be reduced to $3.00 per front footage on Belle
<br />Avenue and Waterbury Avenue, and
<br />
<br /> WHEREAS, this Council by two-thirds vote of the members elected
<br />thereto determines that this resolution is an emergency measure which is
<br />necessary for the immediate preservation of the public peace, property,
<br />health and safety and for the further reason that the improvement provided
<br />in Resolution No. 5362 is immediately necessary to eliminate existing hazards
<br />to vehicular traffic using the streets of this City;

<br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of
<br />Lakewood, Cuyahoga County, State of Ohio, three-fourths Of all members elected
<br />thereto concurring:

<br /> Section 1. That Section 6 of Resolution No. 53i62 adopted on
<br />January 15, 1979 shall be and the same is hereby amended to read as follows:
<br />
<br /> "Section 6. Council hereby determines that the lots and lands
<br />bounding and abutting upon the proposed improvements are specially benefited
<br />by said improvements. Those lots with frontage so benefi!ted by said improve-
<br />ments on Northland Avenue, Parkway Avenue, Lewis Drive, Wyandotte Avenue,
<br />Thoreau Avenue, Woodward Avenue, Parkhaven Row, Clarence ~venue and Wagar
<br />Avenue shall be assesssed at the rate of $5.50 per foot oif frontage and those
<br />lots with frontage so benefited by said improvements on Bielle Avenue and Waterbury
<br />Avenue shall be assessed at the rate of $3.00 per foot ofi frontage. Those lots
<br />with sideyards benefited by any of the said improvements !shall be assessed an
<br />amount equal to the average for all lots having frontage on the improved portion
<br />of that street plus $5.50 per foot on Northland Avenue, P~rkway Avenue, Lewis
<br />Drive, Wyandotte Avenue, Thoreau Avenue, Woodward Avenue,, Parkhaven Row,
<br />Clarence Avenue and Wagar Avenue and $3.00 per foot on Be~le Avenue and Waterbury
<br />Avenue for any lot depth in excess of 150 feet. It is estimated that these
<br />assessments with the exception of Belle Avenue and Waterbury Avenue'shall cover
<br />approximately 50 percent of the actual cost of said improvement, to wit, the
<br />cost of preliminary and other surveys~ plans, specificatibns, profiles and
<br />estimates and of printing, serving and publishing noticesl, resolutions and
<br />ordinances, the amount of damages resulting from the improvement assessed in
<br />favor or any owner of land affected by the improvement and the interest thereon,
<br />the costs incurred in connection with the preparation, levy, and collection of
<br />the special assessments, the cost of purchasing, appropriating, and otherwise
<br />
