RESOLUTION N0. 5409 BY: McBride, Salmon, Wendling, <br /> Brockman, Brown, Chinnock <br /> A RESOLUTION confirming the order of the Board of Building Standards <br /> and Building Appeals dated June 11, 1979 relative to property located at 1456 <br /> Larchmont Avenue, Lakewood, Ohio (Permanent Parcel No. 313-1g-75) and notifying <br /> the property owner of the action to be taken by this muhicipality if compliance <br /> is not accomplished. <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ~AKEWOOD, STATE OF OHIO: <br /> Section 1. That the decision of the Board of Building Standards .and <br /> Appeals dated June 11, 1978, relative to the property located at 1456 Larchmont <br /> Avenue, Lakewood, Ohio (Permanent Parcel No. 313-19-75) which reads as follows: <br /> The Board of Building Standards and Building Appeals hereby <br /> determines that the structure located at 1456 Larchmont <br /> Avenue, Lakewood, Ohio, to be an unsafe structure pursuant <br /> to the standards as set forth in Section 1305.521(1) of the <br /> Building Code of the Codified Ordinances of the City of <br /> Lakewood. The Board further finds that the property owner <br /> has failed to comply with a notice and order from the <br /> Building Department to repair or demolish the structure. <br /> The Board of Building Standards and Building Appeals hereby <br /> orders the property owner, Beth Hansen, to re Pair the prop- <br /> erty located at 1456 Larchmont Avenue in the City of Lakewood, <br /> Ohio, as set forth in Mr. Robert Miller's communication dated <br /> April 10, 1g79 (Exhibit B). Said repairs must commence with- <br /> in thirty (30) days and be completed within ninety (90) days <br /> from this date. Acceptable evidence of the c¢mmencement of <br /> the repairs shall be the obtaining of permits from the City <br /> of Lakewood Building Department and executed Construction <br /> contracts filed with the Building Department. <br /> In lieu of the above, the property owner may file within <br /> thirty (30) days, an executed Sales Agreement for the subject <br /> property specifying alt repairs are to be assumed by the <br /> purchaser and further, that the purchaser must file an <br /> Affidavit with the Building Department confirming the same. <br /> Section 2. That by receipt of this Resolution, the property owner, <br /> Beth Hansen, is hereby notified to comply with the deciy~ion and order of the <br /> Board of Building Standards and Building Appeals as confirmed by this Council. <br /> The property owner, Beth Hansen, is further notified by receipt of this <br /> Resolution that if she fails, neglects or refuses within forty-five (45) <br /> days from the date of service of this Resolution to Comply with the decision <br /> and order of the Board as confirmed by Council, the City, acting through the <br /> Building Commissioner, shall cause said structure to be repaired in accordance <br /> <br /> with the decision and order of the Board as confirmed by City Council. <br /> Section 3.
