RESOLUTION NO. 5424 BYt Brockman, Brown, Chinnock, <br /> McBride, McNally, Wendling, <br /> Salmon <br /> A RESOLUTION confirming the order of the Board of Building Standards <br />and Building Appeals dated October 26, 1979 ~elative ¢o property located at <br />1237-39 Donald Avenue, Lakewood, Ohio (Permanent Parcel No. 312-27-18) and <br />notifying the property Owner of the action to be takem by this municipality <br />if compliance is not accomplished. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF'LAKEWOOD, STATE OF OHIO: <br /> <br /> Section I. That the decision of the Board off Building Standards <br />and Appeals dated October 26, 1979, relative to the pHoperty located at <br />1237-39 Donald AVenue, Lakewood, Ohlo (Permanent Parc~l No. 312-27-18) <br />which reads as follows: <br /> <br />The Board of Building Standards and Building Appeals hereby <br />determines that the structure located at 12371-39 Donald Avenue, <br />Lakewood, Ohio, to be an unsafe structure purlsuant to the <br />standards as set forth in Section 1305.521(i)1of the Building <br />Code of the Codified Ordinances of the City o~ Lakewood. The <br />Board further finds that the property owner h~s failed to comply <br />with a notice and order from the Building Dep~rtment to repair <br />or demolish the structure. The Board of BuilNing Standards and <br />Building Appeals hereby orders the property owner, Jenoe Hoffmann, <br />to repair the property located 1237-39 DonaldlAvenue in the City <br />of Lakewood, Ohio, as set forth in Mr. Jindral's communication dated <br />May 24, 1979 (Exhibit A). <br /> <br /> SeCtion 2. That by receipt of this Resolut[o~, the property owner, <br />Jenoe Hoffmann, is hereby notified to comply with the ~ecision and order of <br />the Board of Building Standards and Building Appeals aS confirmed by this <br />Council. The property owner, Jenoe Hoffmann, is further notified by receipt <br />of this Resolution that if he fails, neglects, or refuses w[thin forty-five <br />(45) days from the date of service of this Resolution ¢o comply with the <br />decision and order of the Board as confirmed by Councill, the City, acting <br />through the Building Commissioner, shall cause said structure to be repaJred <br />in accordance with the decision and order of the Boardlas confirmed by City <br />Council. <br /> <br /> Section 3. That the Clerk of this Councll is hereby authorized <br />and directed to serve a certified copy of this ResolutJion to Jenoe Hoffmann <br />in accordance with the provisions of Section 1305.521(dl) of the Housing Code <br />of the Codified Ordinances of the City of Lakewood. <br /> <br />Adopted ~L~ //~/ /~ 77 <br /> <br /> <br />
