RESOLUTION NO. <br /> <br />5461 BY: <br /> <br />SMmon, Wendlin§, Brown, <br />Chinnock, Gallagher, Graham, <br />M~Bride <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Law <br />of the City of Lakewood to institute an action iln the Common Pleas <br />Court of Cuyaho§a County, Ohio, against the Cru~ & Forster Insurance <br />Co. and United States Fire Insurance Co. on behalf of the City <br />of Lakewood to recover a sum of which is due thel City pursuant to <br />a policy of insurance relative to the Foster Polol claim and <br />ratifying the Complaint filed by the Director ofl Law. <br /> <br /> WHEREAS, this resolution constitutes an lemergency measure <br />providing for the immediate preservation of the ,public health, <br />safety and welfare and for the usual daily operaltion of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CIT~ OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1, That the Director of Law of ~he City of Lakewood <br />be and he is hereby authorized and directed to plrepare and file a <br />Complaint in the Common Pleas Court of Cuyahoga ~ounty, Ohio against <br />the Crum and Forster Insurance Co. and United States Fire Insurance <br />Co. on behalf of the City of Lakewood to recoverl a sum of which is <br />due the City pursuant to a policy of insurance relative to the <br />Foster Pool claim and ratifying the Complaint fi~ed by the Director <br />of Law. <br /> <br /> Section 2. That this resolution is here6y declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of:two-thirds of all <br />members elected to Council, it shall take effect:and be in force <br />immedlatety upon its adoption and approval by the Mayor; otherwise <br />it shall take effect and be in force from and after the earliest <br />period allowed by law. <br /> <br /> <br />
