v <br /> RESOLUTION N0. 5790-83 gy: Brown, Gallagher, Graham, <br /> McBride, Wenlding <br /> AN EMERGENCY RESOLUTION levying a special assessment for the repair <br /> of property located at 1127 Forest Road, Lakewood, Ohio (Permanent Parcel No. <br /> 311-7-52). <br /> WHEREAS, this Council, by two-thirds vote of the members elected there- <br /> to, determine that this Resolution is an emergency measure which is necessary <br /> for the immediate preservation of the public peace, property, health and safety <br /> and for the further reason that the assessment herein provided for must be <br /> promptly levied in order to protect the financial interests of the City; now, <br /> therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the assessment of the cost and expense of repairing <br /> <br /> the structure at 1127 Forest Road, Lakewood, Ohio, declared to be an <br /> unsafe/public nuisance and confirmed by this Council pursuant to Resolution No. <br /> 5611 adopted on October 19, 1981 and amounting to $27,112.28 as reported to <br /> this Council by the Director of Finance, be and the same is hereby adopted and <br /> confirmed and that there be and are hereby levied and assessed upon said <br /> property the amount reported as aforesaid, said property being more fully <br /> described as follows: <br /> Situated in the City of Lakewood, County of Cuyahoga and <br /> State of Ohio and being part of Sub Lot No. Ninety-One <br /> (91) in The Clifton Park Land and Improvement Company's <br /> Clifton Park Allotment of part of Original Rockport Town- <br /> shipi Section No. 23 as shown by the recorded plat of said <br /> Allotment in Volume 29 of Maps, Page 11 of Cuyahoga County <br /> Records, and bounded and described as follows: <br /> Beginning at a point in the Easterly curved line of Forest <br /> Road, which point is distant 10 feet Northerly from the <br /> Southwesterly corner of said Sub Lot 91, measured along <br /> said Easterly curved line of Forest Road, said point being <br /> the Northwesterly corner of land deeded to Evelyn Curtiss <br /> Rose by Deed dated July 20, 1914, recorded in Volume 1579, <br /> Page 288 of Cuyahoga County Records, thence Northerly <br /> measured along said Easterly curved line of Forest Road, <br /> 65 feet to a point in the Northeasterly corner of Sub Lot <br /> No. 91; thence Easterly along the Northerly line of Sub <br /> Lot No. 91, 193.10 feet to the Northeasterly corner of Sub <br /> Lot No. 91; thence Southerly along the Easterly line of <br /> Sub Lot No. 91, 65 feet to the Northeasterly corner of the <br /> land deeded to Evelyn Curtiss Rose, as aforesaid; thence <br /> Westerly in a direct line along the Northerly line of land <br /> deeded to Evelyn Curtiss Rose, as aforesaid, a distance of <br /> 191.11 feet to the place of beginning, be the same more or <br /> less, but subject to all legal highways. <br /> Permanent Parcel 311-7-52 <br /> Section 2. That since the owner of said property to be assessed has <br /> been given an opportunity to pay the assessment against said property in cash <br /> <br /> within 30 days after notice of such opportunity, but has not done so, such <br /> assessment shall forthwith be certified to the County Auditor as provided by Sec- <br /> tion 1305.521(m) of the Codified Ordinances of the City of Lakewood, to be plac- <br /> ed by him on the tax duplicate and collected as other taxes are collected. <br /> Section 3. That the Clerk of Council is hereby directed to file a <br /> <br /> certified copy of this Resolution with the Auditor of Cuyahoga County. <br /> <br />
