RESOLUTION No. 5798=83 By: Brown, Chinnock, Graham, <br /> Gallagher, McBride, <br /> Salmon, Wendling <br /> A RESOLUTION URGING GOVERNOR RICHARD CELESTE TO ENACT REGULATIONS RELATING TO THE <br /> SHIPMENT OF HIGHLY IRRADIATED NUCLEAR FUEL THROUGH THE STATE OF OHIO, AND DECLAR- <br /> ING AN EMERGENCY. <br /> WHEREAS, the Council of the City of Lakewood has become aware of pending ship- <br /> ments of highly irradiated nuclear fuel in its nearby vicinity; <br /> WHEREAS, the public health and safety of the residents of the City of Lakewood <br /> is dependent upon the integrity of the shipping casks used to transport said <br /> irradiated nuclear fuel;. <br /> WHEREAS, the present cask standards are not representative of potential accident <br /> conditions on routes used for the transport of the. irradiated fuel; <br /> WHEREAS, the shipping casks used to transport irradiated fuel have never been <br /> subjected to full scale tests to ascertain their ability to withstand even these <br /> insufficient standards; <br /> WHEREAS, many such casks have been found to be defective despite efforts at <br /> quality control; <br /> WHEREAS, the irradiated fuel shipments from nuclear reactors will increase <br /> sharply in the near future; <br /> NOW, THEREFORE, BE IT RESOLVED., by the Council of the City of Lakewood, State <br /> of Ohio: <br /> SECTION 1: That the Council of the City of Lakewood and its residents urge <br /> Governor Richard Celeste to enact, by executive order, Regulations relating to the <br /> State escort of irradiated nuclear fuel, a Statewide monitoring system of all ship- <br /> ments of irradiated nuclear fuel and to appoint qualified persons to supervise, <br /> train and be responsible for the handling of emergency situations which may arise <br /> as a result of the shipment of the nuclear fuel. It is further urged that the cost <br /> of all of the above be borne by the utilities who are shipping the irradiated fuel. <br /> SECTION 2: That the Council of the City of Lakewood and its residents also <br /> strongly urge that Governor Celeste enact., by executive order, the regulations <br /> involving cask safety and shipper''s liability which have safeguarded Michigan resi- <br /> dents from Canadian irradiated fuel rod shipments since January 19, 1982. <br /> SECTION 3: That the Clerk of Council be, and she hereby is, authorized and <br /> directed to cause the original hereof to be filed in the journal of this Council, <br /> and should cause a fully executed copy hereof to be sent to Richard.. Celeste, Governor <br /> of the State of Ohio, each member of the Ohio General Assembly from. Cuyahoga County, <br /> Vernal G. Riffe, Jr., Speaker of the State. House of Representatives, Harry Meshel, <br /> President of the Ohio Senate, President Ronald Reagan, Ohio Senators John Glenn and <br /> Howard Metzenbaum, and each member of the United States House of Representatives from <br /> the State of Ohio. <br /> SECTION 4: This Resolution is hereby declared to be an emergency measure <br /> necessary for the public peace, health and safety of the City of Lakewood and its <br /> inhabitants for the reason that the shipment of irradiated nuclear fuel poses <br /> potential hazards to the health, safety and welfare of the residents of this City. <br /> <br /> Wherefore, this Resolution shall take effect immediately upon its passage and. approval <br /> by the May r, ~oth~~erwi''~~se, from ppand after the earliest iod al o d by""" ~~'aw~~~ <br /> PASSED: `~('jLrdl('itJ ~ 0~ i?~G~~~.~ <br /> President of Council <br /> EFFECTIVE: <br /> <br /> ATTEST: yor <br /> Clerk of Counci <br /> <br />
