_ i i <br /> RESOLUTION N0: 5837-84 BY~ Chinnock, Graham, <br /> McBride, Salmon, <br /> Wendling <br /> AN EMERGENCY RESOLUTIONS declaring it necessary to improve <br /> certain streets in the City of Lakewood by removal, where necessary, <br /> of the existing surface course, by grading and replacement where <br /> necessary, of the base and by resurfacing with asphaltic concrete <br /> including the necessary replacement and resetting of castings to- <br /> gether with necessary appurtenances hereto. <br /> <br /> ~ WHEREAS, this Council, by two-thirds vote of the members <br /> elected thereto, determines that this P.esolution is an emergency <br /> measure which is necessary for the immediate preservation of the <br /> public peace, property, health and safeXy and for the further <br /> reason that the improvements herein provided are immediately <br /> necessary to eliminate existing ha2ards to vehicular traffic <br /> using the streets of this City; now, therefore <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEtd00D, <br /> STATE OF OHIO <br /> Section 1, That it is necessary to improve the following <br /> streets in the. City of Lakewood- <br /> 1. Delaware Avenue (Lakeland to McKinley) <br /> 2., Hathaway Avenue (Clifton to Merl) <br /> 3. Woodward Avenue (Detroit to Hilliard) <br /> 4, Chase Avenue (Clifton to Merl) <br /> 5. Hird Avenue (Detroit to Clifton) <br /> 6. Blossom Park (Detroit to Cedarwoo d) <br /> 7. Spring Garden (Detroit to Madison) <br /> 8~: Riverside Drive (West Clifton to Edanola) <br /> 9, Edanola Avenue (Riverside to 'S loans) <br /> 10. Westwood Avenue (Detroit to Madison) <br /> 11. Lark Avenue (Thrush to Plover) <br /> 12. Cove Avenue (Detroit to Clifton) <br /> Section 2.. That said streets shall be improved in accor- <br /> dance with specifications hereinafter referred to and now on file in <br /> the office of the City Engineer by removal, where necessary, of the <br /> existing surface course, by grading and replacement cohere necessary, <br /> of the base, and by resurfacing with asphaltic concrete including <br /> the necessary replacementand resetting of castings together with <br /> necessary appurtenances thereto. <br /> Section 3. It is hereby determined and declared that said <br /> improvement is conducive to the public health, convenience and welfare <br /> of said City and the inhabitants thereof, <br /> Section 4. That the plans, specifications and estimates <br /> of the proposed improvements, heretofore prepared and now on file <br /> in the office of the City Engineer, are hereby approved. <br /> Se coon 5. Council hereby determines that the lots and lands <br /> abounding and abutting upon the proposed improvements are specially <br /> benefitted by said improvements. Those lots with frontage so benefitted <br /> by said improvements shall be assessed at the rate of $5..70 per foot of <br /> frontage. Those lots with. side yards benefitted by any of the said im- <br /> provements shall be asse ss ed an amount equal to the average for all lots <br /> having frontage on the improved portion of the street plus $5.70 per foot <br /> for any lot depth in excess of 150-feet. It is estimated that these <br /> assessments shall cover approximately 50 percent (56%) of the actual <br /> cost of said improvement, to wit: the cost of preliminary and other <br /> surveys, plans, specifications, profiles, and estimates and of printing, <br /> serving and publishing notices, resolutions and ordinances, the amount <br /> of damages resulting from theimprovetaent assessed in favor o:r any owner <br /> <br />
