RESOLUTION N0. 5935-85 BY: Chinnock, Graham, Salmon, Wendling <br /> A EMERGENCY RESOLUTION objecting to the transfer of ownership of a D5 <br /> liquor permit from Tasse's Lounge, Inc. to V & L Tavern, Inc. for a liquor <br /> establishment located at 11719 Detroit Avenue in the City of Lakewood. <br /> WHEREAS, the City has been advised that an application has been filed <br /> with the Ohio Department of Liquor Control to transfer the. ownership of a D5 <br /> liquor permit from Tasse's Lounge, Inc. to U & L Tavern, Inc., for a liquor estab- <br /> lishment located at 11719 Detroit Avenue, Lakewood, Ohio. <br /> WHEREAS, investigation discloses that a principal shareholder of the <br /> applicant corporation was active in the management of Vin Mar, Inc. d/b/a <br /> Rainbow Cafe/Excedra, a permit premises located at 1762 East 18th Street, <br /> Cleveland, Ohio, and that said liquor permit business was operated in a manner <br /> that demonstrated a disregard for the laws, regulations and/or local ordinances <br /> of the State of Ohio and the City of Cleveland, and <br /> WHEREAS, the place for which the permit is sought is so located with <br /> respect to the neighborhood that substantial interference with public decency, <br /> sobriety, peace and good order would result from the transfer of ownership of <br /> the permit and operation thereunder by the applicant,and <br /> WHEREAS, this Council determines that the transfer of ownership of <br /> said liquor permit would be contrary to the best interests of the entire <br /> community and would place additional burdens upon the facilities of the Lakewood <br /> Police Department, and <br /> WHEREAS, this resolution constitutes an emergency measure in that it <br /> provides for the immediate preservation of the public health, safety and <br /> welfare; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That this Council hereby strenuously objects to the trans- <br /> fer of ownership by the Department of Liquor Control of the State of Ohio of the <br /> D5 permit for the premises known as 11719 Detroit Avenue,. Lakewood, Ohio from <br /> Tasse's Lounge, Inc. to V & L Tavern, Inc., for the reasons set forth above all <br /> in accordance with the provisions of Section 4303.26 of the Revised Code of Ohio. <br /> Section 2. That the Clerk of Council is hereby authorized and <br /> directed to transmit two certified copies of this Resolution, together with two <br /> copies of a letter of objection and two copies of a letter requesting that the <br /> hearing be held in Cleveland, Cuyahoga County, Ohio, to the Department of Liquor <br /> Control, State of Ohio, Permit Division, no later than March 29, 1985. <br /> Section 3. That this Council designates the Law Department of the <br /> <br /> City of Lakewood to represent it and the City of Lakewood at any hearings before <br /> <br /> the Department of Liquor Control. <br /> Section 4. It is found and determined that all formal actions of this <br /> <br /> Council concerning and relating to the passage of this resolution were adopted <br /> in an open meeting of this Council, and that all such deliberations of this <br /> <br /> Council and of any of its committees that resulted in such formal action, were <br /> in meetings open to the public, in compliance with all legal requirements <br /> including Section 121.22 of the Ohio Revised Code. <br /> <br />
