RESOLUTION NO. 6042 -86-A BY: Chinnock, Gallagher, Graham, <br /> McBride, Wendling <br /> AN EMERGENCY RESOLUTION authorizing and directing the Chief <br /> of Police to sell, througj~ a public auction, various obsolete and non- <br /> functioning City vehicles and/or equipment after publication of legal <br /> notice as provided by law, <br /> WHEREAS, it i~ in the best interest of the City to sell <br /> certain obsolete and non+functioning equipment to make better use of <br /> the space it occupies and to realize a profit from the sale, and <br /> WHEREAS, this resolution constitutes an emergency measure <br /> providing for the immediate preservation of the public health and <br /> welfare, and for the usual daily operation of a municipal department; <br /> now, therefore, <br /> BE IT RESOLVED $Y THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> Section 1. That the Chief of Police be and he is hereby <br /> authorized and directed to sell, through a public auction, the <br /> obsolete and non-functi¢ning City vehicles and/or equipment as set <br /> forth in Exhibit "A" att¢ched hereto and made a part hereof, after <br /> advertising according to haw. <br /> Section 2. I~ is found and determined that all formal <br /> actions of this Council c¢ncerning and relating to the passage of this <br /> resolution were adopted its an open meeting of this Council, and that <br /> all such deliberations ¢f this Council and of any of its committees <br /> that resulted in such formal action, were in meetings open to the <br /> public, in compliance with all legal requirements including Section <br /> 121.22 of the Ohio Revised Code. <br /> Section 3. Thais this resolution is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and <br /> provided it receives the affirmative vote of two-thirds of all members <br /> elected to Council, it shall take effect and be in force immediately <br /> upon its adoption and approval by the Mayor; otherwise, it shall take <br /> effect and be in force of#er the earliest period allowed by haw. <br /> Adopted: ~c~~ <br /> R SIDENT <br /> pJ~~u <br /> CLERF~ <br /> <br /> Approved: L~/ <br /> G~' ` 6 <br /> AYOR <br /> I <br /> <br />
