RESOLUTION NO. 6042 -86-A BY: Chinnock, Gallagher, Graham, McBride, Wendling AN EMERGENCY RESOLUTION authorizing and directing the Chief of Police to sell, througj~ a public auction, various obsolete and non- functioning City vehicles and/or equipment after publication of legal notice as provided by law, WHEREAS, it i~ in the best interest of the City to sell certain obsolete and non+functioning equipment to make better use of the space it occupies and to realize a profit from the sale, and WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public health and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED $Y THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Chief of Police be and he is hereby authorized and directed to sell, through a public auction, the obsolete and non-functi¢ning City vehicles and/or equipment as set forth in Exhibit "A" att¢ched hereto and made a part hereof, after advertising according to haw. Section 2. I~ is found and determined that all formal actions of this Council c¢ncerning and relating to the passage of this resolution were adopted its an open meeting of this Council, and that all such deliberations ¢f this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. Thais this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force of#er the earliest period allowed by haw.
