RESOLUTION No. 6098-86 BY: Brown, Gallagher, Graham, McBride, Salmon, Wendling A RESOLUTION objecting to the issuance of a new D5 liquor permit to applicants Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment located at 14523-25 Madison Avenue, Lakewood, Ohio. WHEREAS, Mark and Julie Shary d/b/a Players Pizza Pasta have applied to the Department of Liquor Control, State of Ohio for the issuance of a new D5 liquor permit for the premises located at 14523- 25 Madison Avenue, Lakewood, Ohio, and WHEREAS, an investigation discloses that the place for which the permit is sought is so located with respect to the neighborhood, that substantial interference with public decency, sobriety, peace, or good order would result from the issuance of the permit and operation thereunder by the applicants, and WHEREAS, the number of those permits already existent in the neighborhood is such that the issuance of the permit would be detrimental to and substantially interfere with the morals, safety or welfare of the public, and WHEREAS, this Council determines that the issuance of the aforementioned permit is contrary to the best interest of the entire community and would place additional burdens upon the facilities of the Lakewood Police Department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby strenuously objects to the granting by the Department of Liquor Control of the State of Ohio of the application of Mark and Julie Shary d/b/a Players Pizza Pasta for the issuance of a new DS liquor permit for the premises known as 14523-25 Madison Avenue, Lakewood, Ohio, all in accordance with the provisions of Sections 4383.26 and 43G3.292 of the Ohio Revised Code. Section 2. That the Clerk of Council is hereby authorized and directed to transmit two certified copies of this Resolution, together with two copies of a letter of objection and two copies of a letter requesting that the hearing be held in Cleveland, Cuyahoga County, to the Department of Liquor Control, State of Ohio, Permit Division, no later than December 5, 1986. Section 3. That this Council designates the Law Department of the City of Lakewood to represent it and the City of Lakewood at any hearings before the Department of Liquor Control. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including ection 121.22 of the Ohio Revised Code.
