RESOLUTION N0. 6178-87 By; Brown, Chinnock, Salmon, Wendling A RESOLUTION objecting to the renewal of D1, D2, D3 and D3A liquor permits issued to Susan Flanagan and Kathleen Keating d/b/a Lakewood Village Tavern for an establishment located at 13437-41 Madison Avenue, Lakewood, Ohio, and requesting a hearing. WHEREAS, D1, D2, D3 and D3A liquor permits have been issued by the Ohio Department of Liquor Control to Susan Flanagan and Kathleen Keating d/b/a Lakewood Village Tavern for an establishment located at 13437-41 Madison Avenue, Lakewood, Ohio, and WHEREAS, said liquor permits will be up for renewal on October 1, 1987, and WHEREAS, the applicant for said permits has operated said liquor permit business in a manner that demonstrates a disregard for the laws, regulations, and local ordinances of the State of Ohio and the City of Lakewood, and WHEREAS, the place for which the permit is sought is so located with respect to the neighborhood that substantial interference with public decency, sobriety, peace and/or good order will result from the renewal of said liquor permits and operation thereunder by the applicant, and WHEREAS, this Council determines that the renewal of said permits is contrary to the best interest of the entire community and would place additional burdens upon the facilities of the Lakewood Police Department, and that the renewal of said liquor permit should be objected to; now, therfore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby strenuously objects to the renewal by the Department of Liquor Control of the State of Ohio of the D1, D2, D3 and D3A liquor permits issued to Susan Flanagan and Kathleen Keating d/b/a Lakewood Village Tavern for premises located at 13437-41 Madison Avenue, Lakewood, Ohio, for the reasons set forth above, all in accordance with the provisions of Section 4307.271 and Section 4303.292 (A) of the Ohio Revised Code. Section 2. That this Council, as the legislative authority of the City of Lakewood, hereby requests a hearing on the foregoing objections as provided in Section 4303.271 of the Ohio Revised Code. Section 3. That the Clerk of Council is hereby authorized and directed to transmit a certified copy of this Resolution, together with a statement by the Law Director of the City of Lakewood that in his opinion the objection is based upon substantial legal grounds within the meaning and intent of Division A of Section 4303.292 of the Ohio Revised Code, and a letter requesting that the hearing be held in Cleveland, Cuyahoga County, to the Department of Liquor Control, State of Ohio, Permit Division, no later than August 31, 1987. Section 4. That this Council designates the Law Department of the City of Lakewood to represent it and the City of Lakewood at any hearings before the Department of Liquor Control.
