RESOLUTION N0. 6201-87 BY: Brown, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> A RESOLUTION urging the elected representatives of the Ohio Senate <br /> and the Ohio House of Representatives to support the passage of Senate Bill 229 <br /> which revised sections of the Ohio Revised Code to allow Regional Council of <br /> Governments to establish Undercover Narcotics Units and recognize Narcotics <br /> Officers so employed as peace officers. <br /> WHEREAS, the Westshore Enforcement Bureau Regional Council of <br /> Governments - Narcotics lJnit has tried various means of manning such unit <br /> since its inception on April 1, 1972, and <br /> WHEREAS, it has been determined that the most effective means of <br /> manning is the employment of undercover agents directly into the Unit by the <br /> Council of Governments, and <br /> WHEREAS, Attorney General Anthony Celebrezze ruled on October 3, <br /> 1986, that such Narcotics Agents were not Undercover Drug Agents as defined by <br /> the statutes of Ohio and could, therefore, not attend basic or advanced police <br /> training schools and could not be empowered to arrest or to qualify for PERS <br /> in the manner granted certain "peace officers", and <br /> WHEREAS, the Westshore Enforcement Bureau Regional Council of <br /> Governments - Narcotics Unit has proven its effectiveness in combating drug <br /> activity and related crimes, and <br /> WHEREAS, the Council of the City of Lakewood recognizes the need for <br /> such undercover agents to be properly trained and covered by legislation in order <br /> to operate effectively and efficiently; now, therefore, <br /> BE IS RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Council of the City of Lakewood hereby expresses <br /> its strong support of Senate Bill 229 which revises sections of the Ohio Revised <br /> Code to allow Regional Council of Governments to establish Undercover Narcotics <br /> Units and recognize Narcotics Officers as peace officers and is now pending in <br /> the Ohio Senate Judiciary Committee and strongly urges its enactment at the <br /> earliest possible time. <br /> Section 2. That the Clerk of Council be and she is hereby authorized <br /> and directed to forward a certified copy of this resolution to President of the <br /> Senate, Paul G. Gillmor, State Senators Charles L. Butts, Gary C. Suhadolnik and <br /> Richard C. Pfeiffer, Jr., State Representative Franci Panehal and Speaker <br /> of the House of Representatives, Vernon G.
