RESOLUTION NO. 6343-89 BY: Brown, Chinnock, Gal lagher, Gazzana, George, Graham, Wendling AN EMERGENCY RESOLUTION demonstrating the objection of the Mayor and this Council to the settlement between the Public Utilities Commission and the Cleveland Electric Illuminating Company. WHEREAS, on January 31, 1989, the Ohio Public Utilities Commission (PUCO) voted 4 to 1 to approve a settlement concerning a rate increase request by the Cleveland Electric Illuminating Company, and WHEREAS, said settlement will raise ~Cleveland Electric Illuminating Company customer bills by 24% over the next three years, and WHEREAS, the rate increase granted pursuant to this settlement to the Cleveland Electric Illuminating Company is excessive and the burden for payment of same often falls inequitably on those who can least afford to pay for such an increase; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Council of the City of Lakewood and the Mayor, for and on behalf of the citizens of Lakewood, bring to the attention of the Public Utilities Commission, the Ohio General Assembly and the Governor of the State of Ohio, their objection to the settlement and rate increase granted to the Cleveland Electric Illuminating Company as a consequence of same. Section 2. That the Council of the City of Lakewood and the Mayor, for and on behalf of the citizens of Lakewood, Ohio, urge our public officials and representatives to take immediate action to set aside said increase by all reasonble means. Section 3. 'That the Clerk of Council be and she is hereby authorized and directed to forward a certified copy of this Resolution to the Ohio Public Utilities Commission, the Speaker of the Ohio House of Representatives, the President of the Ohio Senate, the Governor of the State of Ohio, and State Representative Madeline Cain. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of- its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
