RESOLUTION NO. 6343-89 <br /> <br />BY: Brown, Chinnock, Gal lagher, <br /> Gazzana, George, Graham, Wendling <br /> <br /> AN EMERGENCY RESOLUTION demonstrating the objection of the <br />Mayor and this Council to the settlement between the Public Utilities <br />Commission and the Cleveland Electric Illuminating Company. <br /> <br /> WHEREAS, on January 31, 1989, the Ohio Public Utilities <br />Commission (PUCO) voted 4 to 1 to approve a settlement concerning a <br />rate increase request by the Cleveland Electric Illuminating Company, <br />and <br /> <br /> WHEREAS, said settlement will raise ~Cleveland Electric <br />Illuminating Company customer bills by 24% over the next three years, <br />and <br /> <br /> WHEREAS, the rate increase granted pursuant to this <br />settlement to the Cleveland Electric Illuminating Company is excessive <br />and the burden for payment of same often falls inequitably on those <br />who can least afford to pay for such an increase; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Council of the City of Lakewood and the <br />Mayor, for and on behalf of the citizens of Lakewood, bring to the <br />attention of the Public Utilities Commission, the Ohio General <br />Assembly and the Governor of the State of Ohio, their objection to the <br />settlement and rate increase granted to the Cleveland Electric <br />Illuminating Company as a consequence of same. <br /> <br /> Section 2. That the Council of the City of Lakewood and the <br />Mayor, for and on behalf of the citizens of Lakewood, Ohio, urge our <br />public officials and representatives to take immediate action to set <br />aside said increase by all reasonble means. <br /> <br /> Section 3. 'That the Clerk of Council be and she is hereby <br />authorized and directed to forward a certified copy of this Resolution <br />to the Ohio Public Utilities Commission, the Speaker of the Ohio House <br />of Representatives, the President of the Ohio Senate, the Governor of <br />the State of Ohio, and State Representative Madeline Cain. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of- its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />App roved :~'~~ ~ /~o~; ~ <br /> <br />CLERK <br /> <br /> <br />
