RESOLUTION NO. 6358-89 <br /> <br />BY: <br /> <br />Brown, Chinnock, Gal lagher, Gazzana, <br /> George, Wendling <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the Director of <br />Public Works to enter into a contract with Brom Truck, Inc. for the <br />purchase of three kits to refurbish three Division of Refuse packer <br />trucks, without competitive bidding. <br /> <br /> WHEREAS, 'pursuant to the adoption and approval of Ordinance <br />Numbers 3-89 and 4-89, funds were appropriated and authorization <br />approved for the purchase of three kits to refurbish three Division of <br />Refuse packer trucks and, <br /> <br /> WHEREAS, said kits are only available from one source and, <br />consequently the formal advertising for bids is impractical, and, <br /> <br /> WHEREAS, Section lll.04(a) {lO) provides that contracts under <br />circumstanceS where Council determines that it is impractical to award <br />the contract under competitive bidding procedures may be awarded <br />without competitive bidding, and, <br /> <br /> WHEREAS, a proposal has been received from Brom Truck, Inc. to <br />provide three Complete Crane Carrier Kits which proposal is hereby <br />determined to be reasonable and in the best interest of the City to <br />accept such proposal, and, <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure in that <br />the refurbishing of the packer trucks should be started at the <br />earliest possible time, and it provides for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF"LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. It is hereby determined that Complete Crane Carrier <br />Kits is non-competitive and cannot be secured from any other source <br />other than Brom Truck, Inc., 5281 Engle Road, Brook Park, OH 44142; <br />therefore, the Director of Public Works is hereby authorized and <br />directed to enter into a written contract with Brom Truck, Inc. on the <br />basis of its proposal datec March 14, 1989, in the sum of approximately <br />$147,582.00, a copy of said proposal being attached hereto as Exhibit <br />"A" and made a part hereof as if fully rewritten herein. <br /> <br /> Section 2. That the cost of such kits shall be paid from the <br />Capital Improvement Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Cobncil concerning and relating to the passage of this Resolution <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Cob. ncil and of any of its committees that <br />resulted in such formal action were in meetings open to the public in <br />compliance with all lega) requirements. <br /> <br /> <br />
