RESOLUTION'NO: <br /> <br />6369-89 <br /> <br />BY: Brown, Gallagher, Gazzana, <br /> George, Graham <br /> <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve certain <br />streets in the City of Lakewood by removal, where necessary of the <br />existing surface course, by grading and replacement where necessary, <br />of the base and by resurfacing with asphaltic concrete together with <br />necessary appurtenances hereto. <br /> <br /> WHEREAS, this Resolution is an emergency measure which is <br />necessary for the immediate preservation of the public peace, property, <br />health and safety and for the further reason that the improvements <br />herein provided are immediately necessary to eliminate existing hazards <br />to vehicular traffic using the streets of this City; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That it is necessary to improve the following streets <br />in the City of Lakewood: <br /> <br />o Cranford Avenue (Detroit to Lake) <br />o Brockley Avenue (Detroit to Lake) <br />o Overlook Road (Arlington to Arlington) <br />o Arlington Avenue (W. Clifton Blvd.. to Clifton Rd.) <br />o Clarence Avenue (Madison to Bramley) <br />o Parkwood Avenue (Franklin to Madison) <br /> <br /> Section 2. That said streets shall be improved in accordance <br />with specifications hereinafter referred to and now on file in the <br />office of the City Engineer by removal, where necessary, of the <br />existing surface course, by grading and replacement where necessary, <br />of the base, and by resurfacing with asphaltic concrete including <br />the necessary replacement and resetting of castings together with <br />necessary appurtenances thereto. <br /> <br /> Section 3. It is hereby determined and declared that said <br />improvement is conducive to the public health, convenience and welfare <br />of said City and the inhabitants thereof. <br /> <br /> Section 4. That the plans, specifications and estimates of <br />the proposed improvements, heretofore prepared and now on file in <br />the office of the City Engineer, are hereby approved. <br /> <br /> Section 5. Council hereby determines that the lots and lands <br />abounding and abutting upon the proposed improvements are specially <br />benefited by said improvements. Those lots with frontage so benefited <br />by said improvementstshall be assessed at the rate of $7.00 per foot <br />of frontage. Those lots with side yards benefited by any of the <br />said improvements shall be assessed an amount equal to the average <br />for all lots having frontage on 'the improved portion of the street <br />plus $7.00 per foot for any lot depth in excess of 150-feet. It <br />is estimated that these assessments shall cover approximately fifty <br />percent (50%) of the actual cost of said improvement, to wit: the <br />cost of preliminary and other surveys, plans, specifications, profiles, <br />and estimates and of printing, serving and publishing notices, <br />resolutions and ordinances, the amount of damages resulting from <br />the improvement assessed in favor of any owner of land affected by <br />the improvement and the preparation, levy, and collection of the <br />special assessments, the cost of purchasing appropriating, and <br />otherwise acquiring labor and material and interest on bonds and <br />notes issued in anticipation of the levy and collection of the special <br />assessment together with all other necessary expenditures. Such <br />amount being hereby determined to be equal to the special benefit <br />derived by lands so abounding and abutting these improvements. <br /> <br /> <br />
