RESOLUTION NO. 6380-89 <br /> <br /> BY: Brown, Gallagher, - <br />Gazzana, GeOrge, Graham, Wendli~g <br /> <br /> AN EMERGENCY~RESOLUTION authorizing the Director of Public <br />Works to demolish certain structures on public property owned by the <br />City of Lakewood at West ll7th Street and Detroit Avenue. <br /> <br /> WHEREAS, the property, formerly the Sohio station, at West <br />ll7th Street and Detroit Avenue was acquired by the City of Lakewood <br />for a public purpose, namely public parking, and <br /> <br /> WHEREAS, the subject property is presently being used for <br />public parking and additional space for public parking exists if the <br />present structure is removed, and <br /> <br /> WHEREAS, extensive study has been done regarding the best <br />use for such property, and because of its location, it is an ideal <br />location for expanded public parking and an attractive City gateway <br />entrance, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby determine[ that the <br />property located at West ll7th Street and Detroit Avenue, formerly a <br />Sohio station, is presently best suited for use as a public parking <br />lot and landscaped gateway to our community and that such use is a <br />public purpose benefitting all citizens of Lakewood. <br /> <br /> Section 2. That this Council hereby authorizes the Director <br />of Public Works to remove the existing structure and place a public <br />par~ing lot on the subject premises in substantially the form and <br />manner of the design attached hereto and incorporated by reference <br />herein and to expend presently appropriated or encumbered funds for <br />such purpose and to enter into contracts therefor subject only to <br />further approval by the Board of Control. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />.upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />Approved: ~-/~ ~2~, /gfY <br /> <br />PRESIDENT <br /> <br />CLERK <br /> <br /> <br />
