RESOLUTION NO. 6403-89 BY: Chinnock, Gallagher, Gazzana, George, G~aham, Wendling A RESOLUTION supporting amendments to the Clean Air Act of 1977 and urging adoption of such amendments by the United States Congress. WHEREAS, amendments have been proposed to the Clean Air Act of 1977 which provide for a general reduction in sulphur dioxide emissions by placing a permanent cap on emissions from individual generating units, and WHEREAS, the public utilities industry is opposing such amendments and calling for flexibility by requesting that the limit on emissions apply only to system wide emissions allowing individual generating units to exceed such limits, and WHEREAS, the preservation of our air and its quality is essential to the maintenance of the improvement of the quality of life of all of our citizens, and WHEREAS, this resolution constitutes an emergency measure in the interest of the health, safety and welfare of all our citizens; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council supports the proposed amendments to the Clean Air Act of 1977 which provide for a general reduction in sulfer dioxide emissions by placing a permanent limit on emissions from individual generating units. Section 2. That this Council opposes attempts by industry representatives to substitute for such limits a system placing limits on systems-wide emissions while individual generating units to exceed such limits. utility flexible allowing Section 3. That the Clerk of Council be and she is hereby authorized and directed to forward a certified copy of this resolution to Senator John Glenn, Senator Howard Metzenbaum, Congressman Edward Feighan, Congresswoman Mary Rose Oakar, the Clerk of the United State House of Representatives and the Clerk of the United State Senate. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 5. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
