RESOLUTION NO. 6403-89 BY: Chinnock, Gallagher, <br /> Gazzana, George, G~aham, Wendling <br /> A RESOLUTION supporting amendments to the Clean Air Act of <br />1977 and urging adoption of such amendments by the United States <br />Congress. <br /> <br /> WHEREAS, amendments have been proposed to the Clean Air Act <br />of 1977 which provide for a general reduction in sulphur dioxide <br />emissions by placing a permanent cap on emissions from individual <br />generating units, and <br /> <br /> WHEREAS, the public utilities industry is opposing such <br />amendments and calling for flexibility by requesting that the limit on <br />emissions apply only to system wide emissions allowing individual <br />generating units to exceed such limits, and <br /> <br /> WHEREAS, the preservation of our air and its quality is <br />essential to the maintenance of the improvement of the quality of life <br />of all of our citizens, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure in <br />the interest of the health, safety and welfare of all our citizens; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council supports the proposed <br />amendments to the Clean Air Act of 1977 which provide for a general <br />reduction in sulfer dioxide emissions by placing a permanent limit on <br />emissions from individual generating units. <br /> <br /> Section 2. That this Council opposes attempts by <br />industry representatives to substitute for such limits a <br />system placing limits on systems-wide emissions while <br />individual generating units to exceed such limits. <br /> <br /> utility <br />flexible <br />allowing <br /> <br /> Section 3. That the Clerk of Council be and she is hereby <br />authorized and directed to forward a certified copy of this resolution <br />to Senator John Glenn, Senator Howard Metzenbaum, Congressman Edward <br />Feighan, Congresswoman Mary Rose Oakar, the Clerk of the United State <br />House of Representatives and the Clerk of the United State Senate. <br /> <br /> Section 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 5. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Approved:~ ~/ <br /> <br />PRESIDENT <br /> <br /> <br />
