RESOLUTION NO. 6426-89 BY: Brown, Chinnock, Gallagher, Gazzana, Graham A RESOLUTION objecting to the transfer of ownership of a ~o liquor permit from J.M. Crickett, Inc. to N A B, Inc. dfb/a Pasta Port located at 16200 Madison Avenue, l~kewood, Ohio. WHEREAS, the City has been advised that an application has been filed with the Ohio Department of Liquor Control to transfer the ownership of a D5 liquor permit from J.M. Crickett, Inc. to N A B, Inc. d/b/a Pasta Port for an establishment located at 16200 Madison Avenue, Lakewood, Ohio, and WHEREAS, investigation reveals that although there is nothing objectionable in the background of the sole shareholder of the applicant corporation, the sole shareholder will not be involved in management of said corporation, and WHEREAS, investigation further discloses that the sole shareholder's brother, Frank Bruno, who along with his wife will be the actual manager of the business at 16200 Madison Avenue, has been convicted of a crime for which he is currently on parole for the balance of his ten-year sentence, which relates to his fitness as operator of a liquor establishment, and WHEREAS, this Counci~ determines that the transfer of ownership of said liquor permit would be contrary to the best interests of the entire community and would place additional burdens upon the facilities of the Lakewood Police Department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Counci. 1 hereby strenuously objects to the transfer of ownership by the Department of Liquor Control of the State of Ohio of the D5 liquor permit for the premises located at 16200 Madison Avenue, Lakewood, Ohio, from J.M. Crickett, Inc. to N A B, Inc. d/b/a Pasta Port, for the reasons set forth above all in accordance with the provisions of Sections 4303.26 and 4303.292 of the Revised Code of Ohio. Section 2. That the Clerk of Council is hereby authorized and directed to forward a certified copy of this Resolution together with a letter of objection and a letter requesting that the hearing be held in Cleveland, Cuyahoga County, Ohio, to the Department of Liquor Control, State of Ohio, Permit Division, forthwith. Section 3. That this Council designates the Law Department of the City of Lakewood to represent it and the City of Lakewood at any hearings before the Department' of Liquor Control. ' Section 4.
