RESOLUTION NO.6435-89 <br /> <br />BY: Brown, Chinnock, Gallagher. <br />Gazzana, Wendling <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Mayor to enter into <br />a lease for property located at 13614-16 Madison Avenue, Lakewood, <br />Ohio for and on behalf of the City of Lakewood and dec~c_ing the <br />necessity for the lease of such property for a public purpose, namely <br />the Youth Services Office. <br /> <br /> WHEREAS, the property at 13614-16 Madison Avenue, has been <br />used for five years as the City's Youth Services Office, and <br /> <br /> WHEREAS, the Youth Office has played a vital part in <br />providing outstanding services to Lakewood's young people, and <br /> <br /> WHEREAS, the continuation of such services and the operation <br />of a Youth Services Office will fulfill an important function in <br />improving the quality of life for Lakewood's young people, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure <br />providing for the immediate preservation public health, safety and <br />welfare and for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby determines that the <br />property located at 13614-16 Madison Avenue has been a good location <br />for Lakewood's Youth Services Office and the public interest is served <br />by continuation of such office at the existing location. <br /> <br /> Section 2. That this Council hereby determines that it is <br />in the public interest to enter into a new lease for approximately <br />3,000 square feet of space, plus the basement and parking area <br />previously covered in the former lease, and on terms and conditions <br />consistent therewith with the following additional provisions: an <br />initial term of one year commencing January 1, 1990, with nine options <br />for renewal held by the City to be exercised automatically unless <br />notice is given in writing prior to October tst of any lease term year <br />for nine additional one-year terms; with a base rate for the initial <br />term of Two Thousand One Hundred ($2,100) Dollars per month; with a <br />provision for an annual increase for each option term contained in the <br />lease equal to the increase in the Consumer Price Index over the <br />period of the first term of said lease~ and such other provisions as <br />are necessary to preserve the interest of the City and in form <br />acceptable to the Director of Law. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />PRES IDENT <br /> <br />Approved: <br /> <br />1,9.,- <br /> <br />CLERK <br /> <br /> <br />
