RESOLUTION NO. 6504-90 <br /> <br />BY: Gallagagher, George, Graham <br /> Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the <br />President of Lakewood City Council to engage special counsel to <br />assist City Council in evaluating and negotiating the Final <br />Development Agreement with Lakewood Associates, Inc., for the <br />redevelopment of the downtown commercial area of the City of <br />Lakewood. <br /> <br /> WHEREAS, Lakewood Associates, Inc. has proceeded under and <br />satisfied term and condition under the Preliminary Development <br />Agreement and certain matters have been approved by Council and the <br />Planning Commission regarding the development of the Lakewood City <br />Center, and <br /> <br /> WHEREAS, it is now timely to negotiate the Final Development <br />Agreement for the Lakewood City Center, and <br />Climaco, Climaco, Seminatore, <br />WHEREAS, the firm of Lefkowitz ~ Garafoli Co.~ LPA.has been <br />examined and found qualified and satisfactory to represent Council in <br />such negotiations, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the President of Council be and is <br /> ereby <br />~llmaco,~±lmaco~Uth°ri~ee~n~n~tr~e,directed, to engage the firm of <br />~ouncll to' a: ~ <br /> ssls~ ul~y council' in negotiating and evaluating the <br />Final Development Agreement for the Lakewood City Center proposed <br />by Lakewood Associates, Inc. <br /> <br /> Section 2. That the fees for such Special Counsel shall not <br /> exceed the sum of $ 20,000.00 , and shall be paid from the General <br /> Fund. <br /> <br /> Section 3. It is found' and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />July 1~,, 1990 <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />July 17, 1990 <br /> <br /> <br />
