RESOLUTION NO. 6504-90 BY: Gallagagher, George, Graham Roth, Smith AN EMERGENCY RESOLUTION authorizing and directing the President of Lakewood City Council to engage special counsel to assist City Council in evaluating and negotiating the Final Development Agreement with Lakewood Associates, Inc., for the redevelopment of the downtown commercial area of the City of Lakewood. WHEREAS, Lakewood Associates, Inc. has proceeded under and satisfied term and condition under the Preliminary Development Agreement and certain matters have been approved by Council and the Planning Commission regarding the development of the Lakewood City Center, and WHEREAS, it is now timely to negotiate the Final Development Agreement for the Lakewood City Center, and Climaco, Climaco, Seminatore, WHEREAS, the firm of Lefkowitz ~ Garafoli Co.~ LPA.has been examined and found qualified and satisfactory to represent Council in such negotiations, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the President of Council be and is ereby ~llmaco,~±lmaco~Uth°ri~ee~n~n~tr~e,directed, to engage the firm of ~ouncll to' a: ~ ssls~ ul~y council' in negotiating and evaluating the Final Development Agreement for the Lakewood City Center proposed by Lakewood Associates, Inc. Section 2. That the fees for such Special Counsel shall not exceed the sum of $ 20,000.00 , and shall be paid from the General Fund. Section 3. It is found' and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
