RESOLUTION NO. 6510-90 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the <br />Mayor to enter into a contract for and on behalf of the City of <br />Lakewood with the City of Cleveland for the administration of <br />programs for the prevention, control and abatement of air <br />pollution in accordance with the provisions of the Ohio Revised <br />Code. <br /> <br /> WI{EREAS, the City of Cleveland, Division of Air <br />Pollution Control, has been delegated the authority by the Ohio <br />Environmental Protection Agency (EPA) to represent the Ohio EPA <br />throughout Cuyahoga County for the purpose of administering <br />programs for the prevention, control and abatement of air <br />pollution, and <br /> <br /> WHEREAS, the Ohio EPA has determined that a contract <br />between other municipalities and the City of Cleveland is <br />required if the City of Cleveland is to act as the agent of the <br />Ohio EPA for such purposes within the jurisdictions of <br />municipalities other than the City of Cleveland, and <br /> <br /> WHEREAS, air pollution control services and such <br />programs are more effective and more readily accomplished by <br />cooperation of neighboring municipalities on a countywide basis <br />rather than on an individual basis, and <br /> <br /> WHEREAS, the prevention, control and abatement of air <br />pollution is in the interest of all Lakewood citizens and the <br />more effective Operation of such programs serves and contributes <br />to the public interest, and <br /> <br /> WHEREAS, this resolution constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare, and for the usual daily operation of <br />a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby <br />authorized an directed to enter in an agreement with the City of <br />Cleveland for the purpose of administering programs for the <br />prevention, control and abatement of air pollution in accordance <br />with applicable provisions of the Ohio Revised Code, such <br />contract to be substantially in the form as attached hereto with <br />such additional provisions as may be necessary in the judgment of <br />the Director of Law to protect the public interest. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this resolution were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br /> Section 3. That this resolution is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect <br /> <br /> <br />
