RESOLUTION NO: 6526-90 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public Works <br />to advertise for bids and enter into a contract with the lowest and best <br />bidder after advertisement according to law for the repair and installation <br />of a sewer on Elbur, north of Merl and Detroit Avenue at West Clifton in <br />the City of Lakewood. <br /> <br /> WHEREAS, Council has determined that approximately 290' of' sewer <br />on Elbur, north of Merl and 30' on Detroit at West Clifton is badly <br />deteriorated and in urgent need of replacement, and <br /> <br /> WHEREAS, Council has authorized the preparation of construction <br />drawings and specifications by the Lakewood Engineering Department, and <br /> <br /> WHEREAS, the aforementioned construction drawings and specifications <br />are now on file in the City Engineer's office, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing <br />for the usual daily operation of a municipal department and for the in~ediate <br />preservation of the public safety and welfare; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby <br />authorized and directed to advertise for bids and to enter into a contract <br />with the lowest and best bidder after advertisement according to law for <br />the installation and repair of the sewer on Elbur, north of Merl and Detroit <br />Avenue at West Clifton. <br /> <br /> Section 2. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this resolution <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public, in compliance <br />with all legal requirements. <br /> <br /> Section 3. That this Resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise it shall take effect and be in force <br />after the earliest period allowed by law. <br /> <br />Approved~/~~/~/ <br /> <br /> <br />
