RESOLUTION NO. 6527-90 <br /> <br /> BY: Boscia, Gallagher, <br />Gazzana, George, Graham, Roth,Smith <br /> <br /> A RESOLUTION objecting to the issuance of a new C1 liquor <br />permit to applicants Sohio Oil Co. d/b/a On The Way Mini Market for an <br />establishment located at 14718 Madison Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, Sohio Oil Co. d/b/a On the Way Mini Market have <br />applied to the Department of Liquor Control, State of Ohio for the <br />issuance of a new C1 liquor permit for the premises located at 14718 <br />Madison Avenue, Lakewood, Ohio, and <br /> <br /> WHEREAS, an investigation discloses that the place for which <br />the permit is sought is so located with respect to the neighborhood, <br />that substantial interference with public decency, sobriety, peace, or <br />good order would result from the issuance of the permit and operation <br />thereunder by the applicants, and <br /> <br /> WHEREAS, the number of those permits already existent in the <br />neighborhood is such that the issuance of the permit would be <br />detrimental to and substantially interfere with the morals, safety or <br />welfare of the public, and <br /> <br /> WHEREAS, this Council determines that the issuance of the <br />aforementioned permit is contrary to the best interest of the entire <br />community and would place additional burdens upon the facilities of <br />the Lakewood Police Department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby strenuously objects to <br />the granting by the Department of Liquor Control of the State of Ohio <br />of the application of Sohio Oil Co. d/b/a On The Way Mini Market for <br />the issuance of a new Cl liquor permit for the premises known as 14718 <br />Madison Avenue, Lakewood, Ohio, all in accordance with the provisions <br />of Sections 4303.26 and 4303.292 of the Ohio Revised Code. <br /> <br /> Section 2. That the Clerk of Council is hereby authorized <br />and directed to transmit two certified copies of this Resolution, <br />together with two copies of a letter of objection and two copies of a <br />letter requesting that the hearing be held in Cleveland, Cuyahoga <br />County, to the Department of Liquor Control, State of Ohio, Permit <br />Division, no later than October 19, 1990. <br /> <br /> Section 3. That this Council designates the Law Department <br />of the City of Lakewood to represent it and the City of Lakewood at <br />any hearings before the Department of Liquor Control. <br /> <br /> Section 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all <br /> <br />requi ts. . <br /> CLERK <br /> <br />Approved :f~~/~ /~O <br /> <br /> <br />
