RESOLUTION NO. 6562-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity and intent <br />of the City of Lakewood to appropriate the real property located at <br />1412 Victoria Avenue in the City of Lakewood, County of Cuyahoga and <br />State of Ohio, owned by Arlene Koz and bearing Permanent Parcel No. <br />314-01-108. <br /> <br /> WHEREAS, it has been determined that the subject property is <br />necessary for a public purpose, namely the acquisition and <br />consolidation of property necessary for the Downtown Development <br />Project for the benefit of the entire community and particulary, the <br />redevelopment of the downtown commercial area, and <br /> <br /> WHEREAS, after extensive negotiations between the City and <br />the property owner, the parties have been unable to agree on a <br />purchase price for the subject property, and <br /> <br /> WHEREAS, the City has been certified by the Department of <br />Economic and Community Development of the State of Ohio as an impacted <br />City, and <br /> <br /> WHEREAS, the subject property, hereinafter more fully <br />described, is needed to create and/or preserve jobs, employment <br />opportunities and to improve the economic welfare of the people of <br />this City for the use or development of the subject property for a <br />public purpose, namely the acquisition and consolidation of property <br />necessary for the Downtown Development Project, now, therefore, <br /> <br /> WHEREAS, this resolution constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby determines it necessary <br />and declares it to be the intention of this Council to appropriate the <br />fee simple interest to the premises hereinafter described for the <br />purpose of using the same to create or preserve jobs, employment <br />opportunities and to improve the economic welfare of the people of the <br />City for the use or development of the subject property for a public <br />purpose, namely the acquisition and consolidation of property <br />necessary for the Downtown Development Project, or such other <br />industrial, commercial, housing, distribution or research use and to <br />prevent the spread of blight, deteriorated or deteriorating <br />conditions, said premises being owned by Arlene Koz bearing Permanent <br />Parcel No. 314-01-108, and more fully described in Exhibit "A" <br />attached hereto and incorporated by reference herein. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby <br />authorized and directed to cause written notice thereof to be given to <br />the owner of, person in possession of, or any person having an <br />interest of record therein, or to their authorized agent, and said <br />notice shall be served by a person designated for that purpose by <br />said Clerk of Council and returned made in the manner provided by law <br />for the service and return of summons in civil actions. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br /> <br /> <br />
