RESOLUTION NO. <br /> <br />6637-91 BY: <br /> <br />Boscia, Gallagher, Gazzana, <br />George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve <br />an easement of the City. of Lakewood by constructing thereon a <br />breakwall with concrete modules, fill and-end return. <br /> <br /> WHEREAS, this Council has had presented to it petitions <br />signed by the owners of at least 60% of the front footage of the <br />property abutting, to be assessed for and to be benefited by the <br />improvement herein described; and <br /> <br /> WHEREAS, this Council by two-thirds vote of the members <br />elected thereto determines that this resolution is an emergency <br />measure which is necessary for the immediate preservation of the <br />public peace, property, health and safety and for the further <br />reason that the improvement herein provided is immediately <br />necessary to protect the property and health of the residents of <br />the City which is endangered by the continuing erosion of the Lake <br />Erie shoreline which undermines houses, water lines, sanitary <br />sewers and streets; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Lakewood, Cuyahoga County, State of Ohio, three-fourths of all <br />members elected thereto concurring: <br /> <br /> Section 1. It is necessary to improve an approximately <br />twenty-foot wide easement of the City of Lakewood with its northern <br />boundary located approximately twenty (20) feet north of the <br />currently existing southerly.' shore of Lake Erie in an area now <br />submerged lands but formerly a part of the lots on the northerly <br />side of Edgewater Drive from the easterly line of property now or <br />formerly owned by the Unit Owners of the Lake House Condominium .as <br />tenants in common, now or formerly known as the Permanent Parcel <br />Nos. listed on Exhibit A attached hereto and on the tax list and <br />maps of Cuyahoga County and assigned as its address 11850 Edgewater <br />Drive, westerly approximately 330 feet to the westerly line of'said <br />property. <br /> <br /> Section 2. Said easement shall be improved as shown on <br />the plans hereinafter referred to andnow on file in the office of <br />the Director of Public Works by constructing thereon a breakwall <br />with concrete modules, fill and end return. <br /> <br /> Section 3. It is herebY determined and declared that <br />said improvement is conducive to the public health, convgnienceand <br />welfare of said City and the inhabitants thereof. It is further <br />found and determined that said improvement has been petitioned for <br />by the owners of at least 60% of the front footage of the property <br />abutting said improvement. <br /> <br /> Section 4. The grade of said easement as improved shall <br />be the grade as shown by the plans and profiles which are made a <br />part hereof. <br /> <br /> Section 5. The plans, specifications, estimates and <br />profiles of the proposed improvement, heretofore prepared and now <br />on file in the office of the Director of Public Works, are hereby <br />approved. <br /> <br /> <br />
