RESOLUTION NO. <br /> <br />PLEASE SUBSTI'TUTE FOR RESOLUTION NO. 7090-95-A <br />PLACED ON 1ST READING ON 5/19/97. <br /> <br />7090-95-A <br /> <br />BY: Corrigan, Flannery, George, <br /> Roth, Seelie, Smith <br /> <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve <br />certain streets in the City of Lakewood by removal, where necessary <br />of the existing surface course, by grading and replacement where <br />necessary of the base, by resurfacing with concrete together with <br />necessary appurtenances thereto, and by replacing the sidewalk, curb <br />and driveway apron where necessary. <br /> <br /> WHEREAS, this resolution constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal depart- <br />ment and for the further reason that the improvements herein provided <br />are immediately necessary to eliminate existing hazards to vehicular <br />traffic using the streets of this City; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That it is necessary to improve the following <br />streets in the City of Lakewood: <br /> <br />Clifton Road (Subway/Clifton Boulevard); <br />Forest Road (Clifton Road/Dead End); <br /> <br /> Section 2. That said streets shall be improved in accor- <br />dance with specifications hereinafter referred to and now on file in <br />the office of the City Engineer by removal where necessary of the <br />existing surface course, by grading and replacement where necessary <br />of the base, by 'resurfacing with concrete including the necessary <br />replacement and resetting of castings together with necessary appur- <br />tenances thereto, and by replacing the sidewalk, curb and driveway <br />apron where necessary. <br /> <br /> Section 3. It is hereby determined and declared that said <br />improvement is conducive to the public health, convenience and wel- <br />fare of. said City and the inhabitants thereof. <br /> <br /> Section 4. That the plans, specifications and estimates of <br />the proposed improvements heretofore prepared and now on file in the <br />office of the City Engineer are hereby approved. <br /> <br /> Section 5. Council hereby determines that the lots and <br />lands abounding and abutting upon the proposed improvements are <br />specifically benefited by said improvements shall be assessed at a <br />rate not to exceed $50.00 per foot of frontage based upon an assess- <br />ment rate of not greater than twenty (20%) percent of the cost of the <br />project from back of sidewalk to centerline of street. Those lots <br />with side yards benefited by any of the said improvements shall be <br />assessed an amount equal to the average for all lots having frontage <br />on the improved portion of the street, plus an amount not to exceed <br />$50.00 per foot for any lot depth in excess of 150 feet. The assess- <br />ments shall cover twenty (20%) percent of the actual cost of said <br />improvement, to wit: the cost of preliminary and other surveys, <br />plans, specifications, profiles, estimates and printing, serving and <br />publishing notices, resolutions and ordinances, the amount of damages <br />resulting from the improvement assessed in favor of any owner of land <br />affected by the improvement and the preparation, levy, and collection <br />of the special assessments, the cost of purchasing appropriating, and <br />otherwise acquiring labor and material, interest on bonds and notes <br />issued in anticipation of the levy and collection of the special <br />assessments together with all other necessary expenditures. Such <br />amount being hereby determined to be equal to the special benefit <br />derived by lands so abounding and abutting these improvements. <br /> <br /> <br />
