RESOLUTION NO. PLEASE SUBSTI'TUTE FOR RESOLUTION NO. 7090-95-A PLACED ON 1ST READING ON 5/19/97. 7090-95-A BY: Corrigan, Flannery, George, Roth, Seelie, Smith AN EMERGENCY RESOLUTION declaring it necessary to improve certain streets in the City of Lakewood by removal, where necessary of the existing surface course, by grading and replacement where necessary of the base, by resurfacing with concrete together with necessary appurtenances thereto, and by replacing the sidewalk, curb and driveway apron where necessary. WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal depart- ment and for the further reason that the improvements herein provided are immediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That it is necessary to improve the following streets in the City of Lakewood: Clifton Road (Subway/Clifton Boulevard); Forest Road (Clifton Road/Dead End); Section 2. That said streets shall be improved in accor- dance with specifications hereinafter referred to and now on file in the office of the City Engineer by removal where necessary of the existing surface course, by grading and replacement where necessary of the base, by 'resurfacing with concrete including the necessary replacement and resetting of castings together with necessary appur- tenances thereto, and by replacing the sidewalk, curb and driveway apron where necessary. Section 3. It is hereby determined and declared that said improvement is conducive to the public health, convenience and wel- fare of. said City and the inhabitants thereof. Section 4. That the plans, specifications and estimates of the proposed improvements heretofore prepared and now on file in the office of the City Engineer are hereby approved. Section 5. Council hereby determines that the lots and lands abounding and abutting upon the proposed improvements are specifically benefited by said improvements shall be assessed at a rate not to exceed $50.00 per foot of frontage based upon an assess- ment rate of not greater than twenty (20%) percent of the cost of the project from back of sidewalk to centerline of street. Those lots with side yards benefited by any of the said improvements shall be assessed an amount equal to the average for all lots having frontage on the improved portion of the street, plus an amount not to exceed $50.00 per foot for any lot depth in excess of 150 feet. The assess- ments shall cover twenty (20%) percent of the actual cost of said improvement, to wit: the cost of preliminary and other surveys, plans, specifications, profiles, estimates and printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the preparation, levy, and collection of the special assessments, the cost of purchasing appropriating, and otherwise acquiring labor and material, interest on bonds and notes issued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Such amount being hereby determined to be equal to the special benefit derived by lands so abounding and abutting these improvements.
