RESOLUTION NO 7362-98 <br /> <br />BY; Corrigan, George, Roth, <br /> Seelie, Skindell <br /> <br /> AN <br />gdeard FitzGerald <br /> <br />Large <br /> <br />EMERGENCY RESOLUTION to appoint <br /> to the vacancy in the Office of Member of Council at <br /> <br /> WHEREAS, a vacancy exists in the office of Member of Council at Large of the <br />Lakewood City Council as a consequence of the resignation of Councilmember Bryan Flannery <br />from that office for the purpose of his assuming the office of State Representative in the Ohio <br />General Assembly <br /> <br /> WHEREAS, the remaining members of City Council are empowered to fill such <br />vacancy pursuant to Section 2. of Article III of the Amended Charter of the City of Lakewood; <br />and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfare and for the usual daily operation <br />of municipality; now, therafora, <br /> <br /> BE IT RESOLVED BY THE CiTY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That ~d~ard FitzGerald is hereby appointed to the <br />vacancy in the Office of Member of Council at Large of the Lakewood City Council pursuant to <br />Section 2, of Article III of the Amended Charter of the City of Lakewood <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted Jn an open meeting of <br />this Cour~cil, and that all such deliberations of this Council and of any of its COmmittees that <br />resulted in such formal action were in meetings open to the public in compliance with all legal <br />requirements <br /> <br /> Section 3. That this resolution is hereby declared to be an emergency measure <br />for the reaspns stated in the preamble hereof and provided it receives the affirmative vote of <br />two-thirds of a members elected to Council, it shall take effect and be in force immediately <br />upon its adOPtion and approval by the Mayor, otherwise, it shall take effect and be in force after <br />the ear] est pedod allowed by law <br /> <br />Adopted: ¢,/q¢?' , <br /> ~ O/ / PRESIDENT <br /> <br /> <br />
