Placed on ist Reading 1/19/99 <br />Referred to Public Works Committee. <br /> <br />RESOLUTION: 7376-99 BY: Corrigan, FitzGerald, George, Roth, <br /> Seelie, Skindell, Smith <br /> <br /> A RESOLUTION declaring it necessary to improve Belie Avenue (from <br />Madison Avenue to Bayes Avenue) by the complete reconstruction of the <br />pavement cross-section including the necessary installation and replacement of <br />curbs, aprons and sidewalks, together with ail necessary appurtenances thereto <br />and tree lawn restoration. <br /> <br />BE IT RESOLVED BY THE CiTY OF LAKEWOOD, STATE OF OHIO; <br /> <br />Section 1. That it m necessary to improve the following streets in the City <br /> <br /> Belle Avenue (Madison Avenue to Bayes Avenue) <br /> <br /> Section 2. That said Belle Avenue (Madison Avenue to Bayes Avenue) <br />shall be improved in accordance with specifications hereinafter referred to and <br />now on file in the office of the City Engineer including the complete <br />reconstruction of the pavement cross-section including the necessary installation <br />and replacement of curbs, aprons and sidewaiks, together with all necessary <br />appurtenances thereto and tree lawn restoration. <br /> <br /> Section 3. It is hereby determined and declared that said improvement is <br />conducive to the public health, convenience and welfare of said City and the <br />inhabitants thereof. <br /> <br /> Section 4. That the plans, specifications and estimates of the proposed <br />improvements heretofore prepared and now on file in the office of the City <br />Engineer are here~y approved. <br /> <br /> Section 5. Council hereby determines that the lots and lands abounding <br />and abutting upon the proposed improvements are specifically benefited by said <br />improvements shall be assessed at a rate not to exceed $75.00 per foot of <br />frontage based upon an assessment rate of not greater than twenty (20) percent <br />of the cost of the project from back of sidewalk to centarline of street. Those lots <br />with side yards benefited by any of the said improvements shall be assessed an <br />amount equal to the average for all Jots having frontage on the improved portion <br />of the street, plus an amount not to exceed $75.00 per foot for any lot depth in <br />excess of 150 feet. The assessments shall cover twenty (20) percent of the <br />actual cost of said improvement, to wit: the cost of preliminary and other surveys, <br />publishing notices, resolutions and ordinances, the amount of damages resulting <br />from the improvement assessed in favor of any owner of land affected by the <br />improvement and the preparation, levy, and collection of the special <br />assessments, the cost of purchasing appropriating, and otherwise acquiring <br />labor and material, interest on bonds and notes issued in anticipation of the levy <br />and collection of the special assessments together with all other necessary <br />expenditures. Such amount being hereby determined to be equal to the special <br />benefit derived by lands so abounding and abutting these improvements. <br /> <br /> <br />
