Referred to Rules & ORdinances 9/7/99 <br />Placed on 2nd Reading 9/20/99. <br /> <br />RESOLUTIONNO, 7423-99 BY' Corrigan, FitzgCrald,Ro~h, <br /> ~, cello, SklndeI1, Smxth <br /> A RESOLUTION approving thp use of submerged lands for properg/located at Sublot No 7 <br />of the Lawrence Subdivisinn (Vol. 79, page 38 of?lat records), Sublot 13 of the Matthews and <br />Gilbert Subdivision No 5 (Vol. 34, page 02 of Plat records), andBlock "A" <br />Subdivision (Vol. 29, page 23 Plat records) in the City of Lakewood so that the owner can ~e~t~ke <br />lakeshore protection measures <br /> <br /> WHEREAS, a resident, David C Snyder, 17216 Edgewater Drive, Lakewood, Olfio has <br />proposed fo construct shore protection in Lake Erie at Lakewood, Cuyahoga CoUnty, Ohio; and <br /> <br /> WHEREAS, as par~ of the application to lease submerged land, the parties involved must <br />submit to the Ohio Department of Natural Resources a resolution ficom the Lakewood City Council <br />approving the proposed Use of the submerged land; and <br /> <br /> WHEREAS, attached hereto is a copy of Exhibit A the Lake Erie submerged lands lease <br />description for C David Snyder. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF <br />OHIO <br /> <br /> Section i That the City of Lakesvood fmds and determines that territory being proposed for <br />constmctinn of shore protection, and is further described in the application for a submerged land <br />lease, is not necessary or required for the construction, maintenance or operation by the municipal <br />corporation of breakwaters, piers, docks, wharves, bulkheads, counecting waterways, water <br />terminals facilities and improvements and marginal highways, in the aid of navigation and water <br />commerce, and the land uses specified in the application comply with regulation of permissible land <br />use as determined by the local authority <br /> <br /> Section 2 That the Clerk of Council is hereby authorized and directed to certify a copy of <br />this resolution to the Ohio Deps~ment of Natural Resources, Office of Real Estate and Land <br />Management. <br /> <br /> Section 3 That it is found and determined that all formal actions of this CoUncil conce~mg <br />and relating to the adoption of this resolution were adopted in an open meeting of this Council and of <br />any of its committees that resulted in such fonnal action, were in meetings open to the pubhc, in <br />compliance with all legal requirements, including Section I21.22 of the Ohio Revised Code. <br /> <br />Adopted'_ <br /> <br />Predident <br /> <br />Cle ' // <br /> <br /> <br />
