RESOLUTION NO. 7 4 5 ~ - 9 9 <br /> <br />BY: Corrigan, FitzGerald, George,Roth, <br />Seelie, Skindell, Smith <br /> <br /> A RESOLUTION requesting the Public Utilities Commission of Ohio ("PUCO") to modify the <br />Proposed Rules for Electric Transition Plans (PUCO Case No. 99-1141-EL-ORD) in order to have <br />effective public participation. <br /> <br /> WHEREAS, through the passage of Am. Sub. S. B. 3, which deals with deregulation and <br />restructuring of the electric utility industry in Ohio, the Ohio Generally Assembly gave the PUCO the <br />authority to resolve many issues pertaining to the transition into a deregulated marketplace; <br /> <br /> WHEREAS, electric utility companies are required to file with the PUCO electric transition <br />plans beginning October 5, 1999, and ending January 3, 2000; <br /> <br /> WI-IEREAS, the PUCO's proposed rules under Sec. (L) [and in the notice rule Sec. (J)(1)(d)] <br />permit interested parties only 45 days from the date &the filing of the transition plan in which to file <br />and preliminary objections; <br /> <br /> WHEREAS, the PUCO's proposed rule allowing only 45 days from the date of the filing of the <br />transition plan is not sufficient time for interested persons to effectively review these plans, consult <br />with others, and prepare objectiOns, and the rule works against the prOmotion of any effective public <br />participation; <br /> <br /> WHEREAS, a modification to the PUCO's proposed rules to allow at least ninety (90) days <br />from January 3, 2000, the last date an electric company can file a plan, for the original comments, and <br />further opportunity to make objections specific, would be reasonable time to object to the plans and <br />provide effective public participation; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council requests that the Public Utilities Commission of Ohio modify its <br />proposed rules for electric transition plan, in particular Sec. CL) [and notice rule' Sec. (J)(1)(d)] so that <br />interested persons have a reasonable time of ninety (90) days from January 3, 2000, for original <br />comments, and further opportunity to make objections specific; <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized and directed to forward <br />certified copies .of this resolution to the Docketing Department of the Public Utilities Commission of <br />Ohio, Chairman Alan R. Schriber, Commissioner Rhonda Hartman Fergus, Commissioner Judith A. <br />Jones, Commission Craig A. Glazer and Commissioner Donald L.
