ADD-ONS <br /> <br />RESOLUTION NO. 7 $11 - 0 0 <br /> <br />BY: Corrigan, FitzGerald, George, <br /> Seelie, Skindell, Smith. <br /> <br /> AN EMERGENCY RESOLUTION objecting to the transfer of ownership of C1, C2, <br />and D6 liquor permits from Nayef, Inc. D/B/A Dairy Mart #5-5840 to Majali, Inc. D/B/A Dairy <br />Mart #5-5840 for an establishment located at 14322 Madison Avenue, City of Lakewood, Ohio <br />44107. <br /> <br /> WHEREAS, the City has been advised that an application has been filed with the Ohio <br />Department of Liquor Control to transfer the ownership of C1, C2, and D6 liquor perm/ts fi:om <br />Nayef, Inc. D/B/A Dairy Mart #5-5840 to Majali, Inc. D/B/A Dairy Mart #5-5840 for an <br />establishment located at 14322 Madison Avenue, Lakewood, Ohio; and <br /> <br /> WI-IEREAS, investigation discloses that Wanda J. Tabel still claims to be a filly-percent <br />(50%) stockholder in the corporation which was denied a transfer by the Division of Liquor <br />Control due to her fitness to operate a liquor establishment on May 8, 2000; and <br /> <br /> WHEREAS, Wanda J. Tabel failed to disclose her position as a stockholder in the <br />corporation in violation of Ohio Revised Code §4303.293; and <br /> <br /> WHEREAS, this Council determines that the transfer of ownership of said liquor permits <br />would be contrary to the best interests of the entire community and would place additional <br />burdens upon the facilities of the Lakewood Police Department; and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure in that it provides for the <br />immediate preservation of the public health, safety and welfare; now therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That the Council hereby strenuously objects to the transfer of ownership <br />by the Department of Liquor Control of the State of Ohio of the C1, C2, and D6 liquor permits <br />fi:om the premises known as Nayef, Inc. D/B/A/Dairy Mart #5-5840 to Majali, Inc. D/B/A/ <br />Dairy Mart #5-5840 for the reasons set forth above all in accordance with the provisions of <br />Section 4303.292 of the Revised Code of Ohio. <br /> <br /> Section 2. That the Clerk of Council is hereby authorized and directed to forward a <br />certified copy of this Resolution together with a letter requesting that the hearing be held in <br />Cleveland, Cuyahoga County, Ohio, to the Department of Liquor Control, State of Ohio, P~mit <br />Division, forthwith. <br /> <br /> Section 3. That this Council designates the Law Department of the City of Lakewood <br />to represent it and the City of Lakewood at any hearings before the Department of Liquor' <br />Control. <br /> <br /> Section 4. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open meeting of this <br />Council, and that all such deliberations of this Council and of any of its committees that resulted <br />in such formal action were in meetings open to the public in compliance with all legal <br />requirements. <br /> <br /> Section 5. That this resolution is hereby declared to be an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be in force immediately upon its <br /> <br />Roth, <br /> <br /> <br />
