RESOLUTION NO. 7525-00 <br /> <br />BY:Corrigan, FitzGerald, George, <br /> Seelie, Skindell, Smith. <br /> <br /> AN EMERGENCY RESOLUTION objecting to the transfer of ownership of D5 and D6 <br />liquor permits from Detroiter Inc. D/B/A Detroiter Restaurant to Detroiter Inc. D/B/A Detroiter <br />Kestaurant for an establishment located at 14051 Madision Avenue, City of Lakewood, Ohio <br />44107. <br /> WHEREAS, the City has been advised that an application has been filed with the Ohio <br />Departrnent of Liquor Control to transfer the ownership olD5 and D6 liquor permits from <br />Detroiter Inc. D/B/A Detroiter Restaurant to Detroiter Inc. D/B/A Detroiter Restaurant.for an <br />establishment located at 14051 Madision Avenue, Lakewood, Ohio; and <br /> WHEREAS, this Council determines that the place for which the perrait is sought is <br /> situated within 500 feet of a school and that the operation of the liquor establishment will <br /> substantially and adversely affect or interfere with the normal, orderly conduct of the affairs of <br /> the school; and <br /> WHEREAS, this Council has been advised that the applicant has no intention of <br /> establishing a liquor establishment at 14051 Madison Avenue, Lakewood, Ohio; and <br /> WHEREAS, this resolution constitutes an emergency measure in that it provides for the <br /> immediate preservation of the public health, safety and welfare; now therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEwooD, STATE OF <br />OHIO: <br /> Section 1. That the Council hereby strenuously objects to the transfer of ownership <br />by the Department of Liquor Control of the State of Ohio of the D5 and D6 liquor permits from <br />the premises known as Detroiter Inc. D/B/A Detroiter Restaurant to Detroiter Inc. D/B/A <br />Detroiter Restaurant for an establishment located at 14051 Madision Avenue, Lakewood, Ohio <br />for the reasons set forth above all in accordance with the provisions of Section 4303.292 of the <br />Revised Code of Ohio. <br /> Section 2. That the Clerk of Council is' hereby authorized and directed to forward a <br />certified copy of this Kesolution together With a letter requesting that the hearing be held in <br />Cleveland, Cuyahoga County, Ohio, to the Department of Liquor Control, State of Ohio, Permit <br />Division, forthwith. <br /> Section 3. That this Council designates the Law Department of the City of Lakewood <br /> to represent it and the City of Lakewood at any heatings before the Department of Liquor <br /> Control. <br /> <br /> Section 4. It is found and determined that all formal actions of this Council <br /> concerning and relating to the passage of this resolution were adopted in an open meeting of this <br /> Council, and that all such deliberations of this Council and of any of its committees that resulted <br /> in such formal action were in meetings open to the public in compliance with all legal <br /> requirements. <br /> <br /> Section 5. That this resolution is hereby declared to be an emergency measure for the <br /> reasons stated in the preamble hereof and provided it receives the aiTmnative vote of two-thirds <br /> of all members elected to Council, it shall take effect and be in force immediately upon its <br /> <br />Ro th, <br /> <br /> <br />
