Placed on Second <br />Reading and Referred to Public Warks <br />Committee on 4/2/01. <br /> <br />RESOLUTION' 7543-~1 <br /> <br />BY: Corrigan, FitzGerald, George. <br /> <br /> A RESOLUTION declaring it necessary to improve Gold Coast Lane (from <br />Lake Ave. to north end) by the complete reconstruction of the pavement cross- <br />section including the necessary installation and replacement of curbs, aprons <br />and sidewalks, together with all necessary appurtenances thereto and tree lawn <br />restoration. <br /> <br /> WHEREAS, the Second Amended Charter of the City of Lakewood allows <br />for a special assessment to be implemented in proportion to the benefit which <br />may result from the improvement; and, <br /> <br /> WHEREAS, Gold Coast Lane is thc access road for the condominium <br />units at both the Winton Place and the Carlyle; and, <br /> <br /> WHEREAS, the Winton Place Condominium Association consists of 350 <br />individual units and the Carlyle Condominium Association consists of 549 <br />individual units; and, <br /> <br /> WHER~bAS, the Carlyle Condominium's percentage of the total number of <br />units is equal to 61% and the Winton Place portion of the percentage of total <br />number of units is 39%; and, <br /> <br /> WHEREAS, each condominium owner shall be assessed based upon <br />their Condominium Association's percentage of total number of units and their <br />own percentage of ownership within the individual Condominium Association <br />based upon the Declaration of Ownership maintained by the Condominium <br />Association ,NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO; <br /> <br /> Section 1. That it is necessary to improve the following street in the City <br />of Lakewood: <br /> <br />Gold Coast Lane (from Lake Ave. to north end) <br /> <br /> Section 2 That said Gold Coast Lane (from Lake Ave. to north end) shall <br />be improved in accordance with specifications hereinafter referred to and now on <br />file in the office of the City Engineer including the complete reconstruction of the <br />pavement cross-section including the necessary installation and replacement of <br />curbs, aprons and sidewalks, together with all necessary appurtenances thereto <br />and tree ]awn restoration <br /> <br /> Section 3. It is ile~eby determined ~nd declared that said improvement is <br />conducive to the public health, convenience and welfare of said City and the <br />inhabitants thereof <br /> <br /> Section 4. That the plans, specifications and estimates of the proposed <br />improvements heretofore prepared and now on file in the office of the City <br />Engineer are hereby approved. <br /> <br /> Section 5 Council hereby determines that the lots, land and individual <br />condominium properties abutting the proposed improvements are specially <br /> <br /> <br />
