Placed <br />on First Reading and Referred to Public Works <br />Cmte on 3/19/01~Placed on Second Reading and <br />Referred to Public Works Cm%e on 4/2/0I. <br /> <br />RESOLUTION: 7544-01 <br /> <br /> BY' Corrigan, FitzGerald, George, <br />Roth, Seelle, Sklndell, Smith. <br /> <br /> A RESOLUTION declaring it necessary to improve Homewood Drive (from <br />Lake Avenue to Edgewater Drive) by the complete reconstruction of the <br />pavement cross-section including the necessary installafion and replacement of <br />curbs, aprons and sidewalks, together with all necessary appurtenances thereto <br />and tree lawn restoration <br /> <br /> WHEREAS, some property owners of Homewood Avenue wish to <br />preserve their sandstone sidewalks; and <br /> <br /> WHEREAS, the City desires to assist the property owners of Homewood <br />Avenue who wish to preserve their sandstone sidewalks; and <br /> <br /> WHEREAS, the City will credit to the property owner for the City's portion <br />of the cost of a concrete sidewalk to be applied toward the property owner's <br />sandstone sidewalk cost should they elect sandstone; and <br /> <br /> WHEREAS, the property owner will be responsible for the cost of the <br />sandstone sidewalk less credit for the City's portion of a concrete sidewalk; and <br /> <br /> WHEREAS, said costs for sandstone shall be added to the property <br />owner's assessment <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO; <br /> <br /> Section 1. That it is necessary to improve the following street in the City <br />of Lakewood: <br /> <br />Homewood Drive (from Lake Avenue to Edgewater Drive) <br /> <br /> Section 2 That said Homewood Drive (from Lake Avenue to Edgewater <br />Drive) shall be improved in accordance with specifications hereinafter referred to <br />and now on file in the office Of the City Engineer including the complete <br />reconstruction of the pavement cress-section including the necessary installation <br />and replacement'of curbs, aprons and sidewalks, together with all necessary <br />appurtenances thereto and tree lawn restoration. <br /> <br /> Section 3. R is hereby determined and declared that said improvement is <br />conducive to the public health, convenience and welfare of said City and the <br />inhabitants thereof <br /> <br /> Section 4. That the plans, specifications and estimates of the proposed <br />improvements heretofore prepared and now on file in the office of the City <br />Engineer are hereby approved <br /> <br /> Section 5, Council hereby determines that the lots and lands abounding <br />and abutting upon the proposed improvements are specially benefited by said <br />improvements and shall be assessed at a rate not to exceed $36.00 per foot of <br />frontage based upon an assessment rate of not greater than twenty (20) percent <br />of the cost of the project from back of sidewalk to centedine of street However, <br />any property owner electing for sandstone sidewalks shall be assessed at a rate <br />not to exceed $36 00 per foot of frontage based upon an assessment rate of not <br />greater than twenty (20) percent of the cost of the project from the front of <br />sidewalk to the center line of the street and, in addition shall be assessed 100% <br /> <br /> <br />
