RESOLUTION NO. 7574-0I <br /> <br />BY: Corrigan, FitzGerald, George, Roth, <br /> Seelie, Sklndell, SMith. <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Mayor or her designee to apply for financial assistance through <br />the Cuyahoga County Brownfield Redevelopment Loan Fund for the purposes of funding the potential purchase and <br />environmental remedlation of the property (PP# 312-33-017) located at :11726-28 Detroit Avenue and 1385-87 Hird <br />Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, the property (PP# 312-33-017) located at 11726-28 Detroit Avenue and 1385-87 Hird Avenue, <br />Lakewood, Ohio have been on the market for nearly five (5) years; and <br /> <br /> WHEREAS, it is in the public interest to see that this property be returned to an economically viable and tax <br />generating use; and <br /> <br /> WHEREAS, the City of Lakewood has comPleted a Phase ! and Phase II Environmental Assessments of the <br />property utilizing Community Development Block Grant dollars and a Cuyahoga County Brownfield Technical <br />Assistance Grant; and <br /> <br /> WHEREAS, as a result of the Phase I and Phase TT Assessments, Asbestos-Containing Materials (ACMs) were <br />identified and an Underground Tank was determined to have been installed at some point on the subject property; <br />and <br /> <br /> WHEREAS, certain environmental hazards require remediation prior to the sale of said property to potential <br />buyers and, further it was determined that no remediation or further action is required related to the Underground <br />Tank; and <br /> <br /> WHEREAS, Cuyahoga County has Brownfield Redevelopment Loan Funds available to fund a potential <br />purchase and remediation of said property; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected hereto determines that this Resolution is <br />an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ART/CLE <br />III, SECT/ONS :10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that this project is <br />necessary to facilitate the sale and remediafion of said property for an economically viable and tax generating use. <br /> <br />NOW, THEREFORE, BE TT ORDAINED BY THE COUNC/L OF THE CTI'Y OF LAKEWOOD, COUNTY OF CUYAHOGA, STATE <br />OF OHIO: <br /> <br /> Section 1. The Council of the City of Lakewood hereby authorizes the Mayor or her designee to make <br />application to Cuyahoga County for a Brownfield Redevelopment Loan, for the purposes of funding a potential <br />purchase and environmental remediation of the property (PP# 312-33-017} located at 11726-28 Detroit Avenue and <br />1385-87 Hird Avenue, Lakewood, Ohio. <br /> <br /> Section 2. The Council of the City of Lakewood hereby determines that application for such funding for <br />said purchase and remediation is in the. best interest of the public health, safety, and welfare due to the known <br />Asbestos-Containing Materials on the property and will further the goal of returning the property to an economically <br />viable and tax generating use. <br /> <br /> Section 3. It is found and determined that all formal actions of this Council concerning and relating to <br />the passage of this Resolution were adopted in an open meeting of this Council, and that all such deliberations of this <br />Council and any of its committees that resulted in such formal actions, were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 4. This Resolution is hereby declared to be an emergency measure for the reasons set forth and <br />defined in the preamble of this Resolution, and provided it receives the affirmative vote of at .least five (5) of its <br />members elected to Council, this Resolution shall take effect and be in force immediately upon its adoption by the <br />Council and approval by the Mayor. <br /> <br />President of Council <br /> <br /> <br />
