RESOLUTION: <br /> <br />BY: corrigan, Dunn, George, Roth, Seelie, <br /> Skindell. <br /> <br /> A RESOLUTION declaring it necessary to improve lndianola Drive <br />( Hilliard to Riverside) and Overbrook Avenue (Riverway to Indianola) by the complete <br />reconstruction of the pavement cross-section including the necessary installation and <br />replacement of curbs, aprons and sidewalks, together with all necessary appurtenances <br />thereto and tree lawn restoration. <br /> <br />BE Tr RESOLVED BY THE Ct'fY OF LAKEWOOD, STATE OF OHIO; <br /> <br /> Section :t. That it is necessary to improve the following streets in the City of <br />Lakewood: <br /> <br />Zndianola Drive ( Hilliard to Riverside) and <br />Overbrook Avenue (RJverway to Zndianola) <br /> <br /> Section 2. That said Indianola Drive ( Hilliard to Riverside) and Overbrook <br />Avenue (RNerway to [ndianola) shall be improved in accordance with spedflcations <br />hereinafter referred to and now on file in the office of the City Engineer induding the <br />complete reconstruction of the pavement cross-section including the necessary <br />installation and replacement of curbs, aprons and sidewalks, together with all necessary <br />appurtenances thereto and tree lawn restoration. <br /> <br /> Section 3. [t is hereby determined and declared that said improvement is <br />conduclve to the public health, convenience and welfare of said City and the inhabitants <br />thereof. <br /> <br /> Section 4. That the plans, specifications and estimates of the proposed <br />improvements heretofore prepared and now on file in the office of the City Engineer are <br />hereby approved. <br /> <br /> Section 5. Council hereby determines that the lots and lands abounding and <br />abutting upon the proposed improvements are specifically beneflt~ by said <br />improvements shall be assessed at a rate not to exceed $39.58 per foot of frontage <br />based upon an assessment rate of not greater than twenty (20) percent of the cost of <br />the project from back of sidewalk to centerline of street. Those lots <br />with side yards benefited by any of the said improvements shall be assessed an <br />amount equal to the average for all lots having frontage on the improved' portion of the <br />street, plus an amount not to exceed $39.58 per foot for any lot depth in excess of 150 <br />feet. The assessments shall cover twenty (20) percent of the actual cost of said <br />improvement, to wit: the cost of preliminary and other surveys, publishing notices, <br />resolutions and ordinances, the amount of damages resulting from the improvement <br />assessed in favor of any owner of land affected by the improvement and the <br />preparation, levy, and collection of the special assessments, the cost of purchasing <br />appropriating, and otherwise acquiring labor and material, interest on bonds and notes <br />Issued in anticipation of the levy and collection of the special assessments together with <br />all other necessary expenditures. Such amount being hereby determined to be equal to <br />the special benefit derived by lands so aboUnding and abutting these improvements. <br /> <br /> SectiOn 6. That the Clerk of this Council be and she is hereby directed to deliver <br />a certified copy of this resolution to the Director of Rnance of this City. <br /> <br /> <br />
